Voting No: None. <br /> <br />Case #8: <br /> <br />Request for Extension to Record Final Plat for River Pines 4th Addition and <br />Amendment to Development Agreement for River Pines 3rd Addition; Case <br />of Orrin Thompson Homes <br /> <br />Community Development Director Frolik stated that on May 12, 1998, the Ramsey City Council <br />granted final plat approval to Apple Ridge 2~d, 3~d, 4% and 5tx~ Additions being developed by <br />Good Value Homes. Subsequently, the property was sold and US Home Corporation or Orrin <br />Thompson Homes and they assumed the obligations of the development agreements. US Home <br />requested a plat name change and recorded the second phase of Apple Ridge as River Pines and <br />the third phase of Apple Ridge as River Pines-2® Addition. Accordingly, the 4~ and 5th phases of <br />Apple .Ridge will be recorded as River Pines 3~a and River Pines 4th Additions. City Code <br />establishes a two year time frame from the date of final plat approval to record a plat at the <br />County. in 2000, the City Council granted a one year extension to May 12, 2001, to the <br />recording of the final two phases of River Pines. River Pines 3rd Addition will be recorded by <br />May 12, 2001. However, River Pines 4tl~ Addition is not on a timeline to be recorded by May 12, <br />2001. Orrin Thompson Homes has submitted a written request for an additional six-month <br />extension in which to record the final phase of River Pines. City Code states that "the Council <br />may extend the period upon written application by the subdivider and subject to all applicable <br />performance conditions and requirements, or the Council may require submission of a new <br />application unless the Council finds that substantial activity and investment has occurred in <br />reasonable reliance on the approved application and the subdivider will suffer substantial <br />financial damage as a consequence of a requirement to submit a new application." .in <br />conjunction with the extension for recording, the deadline for installing the Stage I <br />improvements in Item #6 of the Development Agreement also needs to be modified. Given that <br />the extension to record is at the end of this construction season, staff recommended amending the <br />completion date to the end of year's construction season or November 30, 2002. Staff and the <br />Developer are currently working on recording the plat and development agreement for River <br />Pines 3~a Addition by the May 12, 2001 deadline. At the time the extension was granted, staff <br />erroneously did so without amending the deadline for installing Stage I improvements in that <br />phase. However, there is still time to do that and record the development agreement by May 12, <br />2001. Staff requested Council approval to change the improvement construction deadline for <br />River Pines 3~d Addition to the end of this year's construction season or November 30, 2001. <br /> <br />Motion by Mayor Gamec, seconded by Councilmember Anderson, to adopt Resolution #01-04- <br />193 granting a six-month extension to November 12, 2001, to record the final plat of River Pines <br />4th Addition and modify the deadline for completing the Stage I Improvements to November 20, <br />2002. <br /> <br />Motion carried.
