-78- WHE~AS, the City Council finds that an interim ordinance placing a moratorium on the development of certain parcels is necessary' to protect the planning Process and the health, safe~ and welfare of the citizens of Ramsey during the Northwest Corridor River Crossing Study process. SECTION 3. PROHIBITION During the term of this Ordinance, notwithstanding Chapter 9 of the City Code, entitled "Zoning and Subdivision of Land," no subdivision, rezoning, site plan approvals, conditional use permits or variances of any k/nd shall be permitted, except that applications for interim use permits for which no permanent or temporary, building is required may be considered. UNDUE HARDSHIP EXCEPTIONS The City Council may grant an :exception ro the provisions of this Ordinance when, in its opinion, undue hardship or a practical difficulty may result form strict compliance. In granting an exception, the City. Council shall prescribe any conditions that it deems necessary to or desirable for the protection of the public interest. NO exception shall be granted unless the City Council finds: That there are special circumstances or 'conditions affecting said property, such that the strict application of the provisions of this Moratorium Ordinance would deprive the petitioner of the reasonable use of petitioner's land. That the exception is necessary for the preservation and enjoyment of a substantial property right of the petitioner. That the granting of the exception will not be detrimental to the public welfare or injurious ro other property in the area in which the property is situated. I I .I I I I I I I I I I
