Councilmember introduced the following resolution an moved for its adoption: I I I I I I I I I I I I RESOLUTION #01-06- A RESOLUTION APPROVING THE ISSUANCE OF AN INTERIM USE PERMIT FOR THE ESTABLISHMENT OF AN OUTDOOR PAINTBALL RECREATIONAL FACILITY LOCATED IN AN INDUSTRIAL AREA BASED UPON FINDINGS OF FACT # AND DECLARING TERMS OF SAME. WHEREAS, Diehard Paintball (Permittee) has properly applied for an interim use permit to establish an outdoor paintball course on the property generally know as 14622 Ferret Street and legally described as follows: Lot 2, Block 1 Hy~10 Ramsey, together with that part of the Southwest Quarter of the Northeast Quarter of Section 29, Township 32, Range 25, Anoka County, Minnesota, lying northeasterly of the northeasterly line of the Burlington Northern Railroad. (the "Subject Property") WHEREAS, the Planning Commission met on June 5, 2001, conducted a public hearing and recommended City Council approval of the request. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: Based on Findings of Fact # ., an interim use permit ("Permit") to establish an outdoor paintball course in an Industrial area on the Subject Property is hereby granted to Diehard Paintball ("Permit-tee"). 2. The permit shall terminate on June 30, 2006. 3. The Permittee will have operating hours of Monday thru Friday, 10:00am - 10:00pm, Saturday 8:00am - 10:00pm and Sunday 12:00pm - 10:00pm. 4. The Permittee herein agrees not to construct any permanent structures without the prior approval of the City. 5. The paintball use shall require an additional, separate $1,000,000.00 public liability insurance policy as approved by the City. The City, in its discretion, may review the paintball use in the event it receives frequent complaints, including noise levels, as a result of the use. This review procedure shall be the same as the conditional use permit revocation procedure of Chapter 9 of the City C6de. Excessive noise complaints shall be cause for revocation of the paintball use. The City reserves the right to revoke the paintball use in the event it finds the use is either harmful to the public health and welfare and/or the quiet enjoyment and use of neighboring properties.
