The amount of the deposit shall be equal to five <br />percent (5%) of the estimated cost of the Required Improvements or nine thousand four <br />hundred forty four dollars ($9,444.00). Upon completion of the Improvements to the <br />satisfaction of the City, any surplus balance remaining in the City's escrow account shall <br />be refunded to the DEVELOPER. <br /> <br />STORMWATER MANAGEMENT FEE. The CITY has enacted a Stormwater <br />Management Fee in the amount of Three Thousand Seven Hundred Forty One Dollars <br />($3,741.00) per commercial acre. The amount of Stormwater Management Fee due on <br />the Site is six thousand three hundred sixty dollars ($6,360:00) (1.71 acres x $3,741/acre). <br />A cash payment will be required prior to the CITY releasing the Building Permit. <br /> <br />FIRE LANES. Fire lanes shall be maintained on the Site. The exact location of these <br />items on the Site shall be as directed by the City's Fire Chief. <br /> <br />LIGHTING. Any lighting installed on the structure or in the parking lot is subject to the <br />prior approval of the City Engineer and Shall be designed so as to deflect light away from <br />all adjacent parcels. Bulbs emitting in excess of 3,000 lumens (150 watts) shall be so <br />directed that the bulb is not visible from off of the property where such light source is <br />located <br /> <br />BUILDING FACADE. The Permittee agrees to construct the building exteriors with <br />integrally color treated rock face block and vinyl siding in accordance with the Exterior <br />Elevations prepared by Lampert Architects dated June 5, 2001. <br /> <br />REQUIREMENTS FOR BUILDING PERMIT AND CERTIFICATE OF <br />OCCUPANCY. No building permit for the Site will be issued until the permittee has: a) <br />signed and returned this Development Permit; b) provided the required cash payment for <br />stormwater management in accordance with Item #7 of this Permit; c) provided the <br />required financial guarantee in accordance with Item #13 of this Permit; d) provided the <br />required cash deposit for inspection fees in accordance with Item #6 of this Permit; and e) <br />provided the City with a copy of the Grading and Drainage Permit issued by the Lower <br />Rum River Water Management Organization. No Certificate of Occupancy for the <br />structure will be issued until: a) the Required Improvements are accepted by the City; <br />and b) the landscaping maintenance guarantee has been provided in accordance with <br />Item # 14 of this Development Permit. <br /> <br />IMPROVEMENT CONSTRUCTION SCHEDULE. The Required Improvements <br />shall be completed before June 30, 2002. <br /> <br />ESCROW FOR REQUIRED IMPROVEMENTS. In order to ensure the installation <br />of the Required Improvements in accordance with City specifications and in a timely <br />manner, the Permittee shall be required to deposit with the City a cash escrow or letter of <br />credit, approved as to form by the City, in the amount of two hundred eighty three <br />thousand three hundred twelve dollars ($283,312.00) which is 150% of the City's <br />estimated cost of the Improvements. Prior to the issuance of the building permit, all <br />financial guarantees must be provided as required herein. <br /> <br />r215- <br /> <br /> <br />
