PARCEL 3: The Northeast quarter of the Southeast quarter of Section 26, Township 32, Range 25, Anoka County, Minnesota. (the "Subject Property") NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: That the Board of Adjustment conducted a public hearing pursuant to Section 9.03.05 of the Ramsey City Code on June 5, 2001 and that said public hearing was properly advertised and that the minutes of said public hearing are hereby incorporated as a part of these findings by reference. 2. That the subject property is proposed to be rezoned t5om B1, Business and RI, Single Family to Planned Unit Development (P.U.D.). 3. That the subject property is proposed to be subdivided to allow for 73 single-family lots, 152 townhome units, and an 82-unit apartment building for senior citizens. 4. That City Ordinances restrict structure heights to 35 feet in all zoning districts. That the Applicant is proposing to construct a three story apartment building that will reach a maximum height of. 52 feet and therefore exceeds the 35-foot height restriction by 17 feet. 6. That the proposed structure is proposed to house at least 82 senior citizens, some of which may have limited mobility to escape from a fire. The applicant has provided staff with information regarding the height of the third story windows. In all locations on the building, the bottom of the third story window is below 35 feet. The lowest point of the third story windows range from 23' 10" to 32' 7". The top of the third story windows range from 27' 8" to 36' 6". 8. That the 35~foot height restriction is based on the reach capabilities of fire suppression equipment in the City's fire department. RESOLUTION #01-06-220 Page 2 of 3 .-321-
