That the subject property is proposed to be rezoned t5om B1, Business and RI, Single <br /> Family to Planned Unit Development (P.U.D.). <br /> <br />3. That the subject property is proposed to be subdivided to allow for 73 single-family <br /> lots, 152 townhome units, and an 82-unit apartment building for senior citizens. <br /> <br />4. That City Ordinances restrict structure heights to 35 feet in all zoning districts. <br /> <br />That the Applicant is proposing to construct a three story apartment building that will <br />reach a maximum height of. 52 feet and therefore exceeds the 35-foot height <br />restriction by 17 feet. <br /> <br />6. That the proposed structure is proposed to house at least 82 senior citizens, some of <br /> which may have limited mobility to escape from a fire. <br /> <br />The applicant has provided staff with information regarding the height of the third <br />story windows. In all locations on the building, the bottom of the third story window <br />is below 35 feet. The lowest point of the third story windows range from 23' 10" to <br />32' 7". The top of the third story windows range from 27' 8" to 36' 6". <br /> <br />8.
