-374- <br /> <br />Councilmember Zimmerrnan introduced the following resolution and moved for its adoption: <br /> <br /> RESOLUTION #93-03-033 <br /> A RESOLUTION APPROVING THE ISSUANCE OF AN AMENDED <br />CONDITIONAL USE PERMIT TO DANNY'S ALUMINUM PROCESSING, INC. <br />BASED ON RESOLUTION ~-93-02-023 ADOPTING FINDINGS OF FACT #0329 <br /> AND DECLARING TERMS OF CONDITIONAL USE PERMIT. <br /> <br /> WHEREAS, the consideration of approval for the request for a conditional use permit <br />amendment is based on the City's determination that the amendment is consistent with the intent <br />and purposes of Chapter 9.03.04 (ConditiOnal Use Permits) of the Ramsey City Code. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />On March 9, 1993, an amended conditional use permit ("CUP") was approved for issuance by the <br />City of Ramsey ("City") to Danny's Aluminum Processing, Inc. ("Permit Holder") to expand the <br />operations of the aluminum processing facility to include the disassembly of engines and <br />transmissions on the property general known as 14050 Basalt Street N.W. and legally reset/bed as <br />follows: <br /> <br />Lot 1, Block 4, Gateway North Industrial Park Plat #2, Anoka County, Minnesota, <br />hereinafter "sire". <br /> <br />This permit is issued pursuant to Section 170.013D of the Ramsey City Code. The conditions of <br />this permit are as follows: <br /> <br />Term. This permit shall remain in effect so long as the conditions imposed herein are <br />complied with. <br /> <br />Noise. Noises emanating from the site and Operations shall be in compliance with and <br />regulated by the State of Minnesota Pollution Control Standards, Minnesota Rules <br />7010.0010 to 7010.0080, as amended except as modified herein by City performance <br />requirements. <br /> <br />DusffAsh/Particutates. The emission of dust, ash or other particulate matter shall be in <br />compliance with and regulated by the State of Minnesota Pollution Control Standards, <br />Minnesota Rules 7005.0010 to 7005.0080, 7005.2770 subp. 2.A and 40 CFR Parr 50, as <br />amended except as modified herein by City. performance requirements. <br /> <br />Odor. The emission of odor from the operation shall be in compliance with and regulated <br />by the State of Minnesota Pollution Control Standards, Minnesota Rules 7005.0920, as <br />amended except as modified herein by City performance requirements. <br /> <br />Smoke. The emission of smoke from the operation shall be in compliance with and <br />regulated by the State of Minnesota Pollution Control Standards, Minnesota Rules <br />7005.0480 subp. 1.B., as amended except as modified herein by City performance <br />requirements. <br /> <br />Furnace Emissions and Monitoring. Emissions from the melt furnace shall comply <br />with State and Federal regulations as they exist and may be modified from time to rime <br />during the period of this CUP. An independent testing laboratory shall conduct emissions <br />monitoring at least once per year or on a more frequent basis if pollutants are in excess of <br />standards.
