23. 24. Water Quality. Surface and ground waters originating outside and passing through or adjacent to the Sire and runoff water discharged from the Site shall, at its point of deparcure from the Site, meet all applicable federal and state water quality standards as they exist from rime to time during the period of this CUP. The operator shall perform any water treatment necessary to comply with applicable stare and federal water quality srkndards as they exist from time to time during the period of this CUP. Grading and drainage plans shall be submitted to and approved by the City Engineer. Berming shall be installed as necessary to control run-off. Screening. The Permit Holder agrees to screen the aluminum processing facility from any public sn'eet. Such screening shall be achieved using gating, landscape elements, and/or plant materials which will achieve up to 90% opacity. Supplemental screening of the Site may be ordered by the City to comply with the then current screening requirements for outside storage on industrial proper~y. 25. 26. Off-Street Parking. Off-street parking shall be'provided such that there is at least one parking space for each employee on the maximum' working shift plus three spaces for visitor parking. Surfacing of Work Areas. All storage areas, parking areas, and driveway areas shall be surfaced with bituminous or concrete. I i I I 27. 28. 29. Building Permits. No construction or remodeling of any structures shall commence prior to the issuance of a building permit by the City Building Official and sire plan approval by the City Council. Electrical. The building's electrical system must be inspected and brought up to code within 30 days of this CUP. An affidavit of compliance shall be filed with the City within five working days after final inspection. Sanitary Sewer. The Permit Holder shall petition for City sewer and water within 30 days of the date of action on this CUP. In the event that the petition fa/Is, the Perm/t Holder shall install an on-site system or submit an.alternative sewage handling treatment plan for Council approval. I I I I I I 30. 31. 32. Scope and Conduct of Operations. The operations permitted by this CUP may be performed on the Subject Property in conformance with existing statutory and regulatory authority and requirements of the City, Anoka County, Minnesota ("County"), and the Minnesota Pollution. Control Agency CMPCA"). Furnaces. This permit shall be issued allowing for the use of two melt furnaces as described by the applicant in the CUP application support information. An increase in furnace capacity or a third melt furnace shall not be added to the operation without application and approval of a new CUP. Closure Due to CUP Revocation, Other Cit/'cumstances. In the event this CUP is revoked or the Permit Holder closes operation of the aluminum processing operation for any reason, including but without limitation, order of the court or other agency of competent jurisdiction, bankruptcy, insolvency, or abandonment, the Permit Holder shall immediately proceed to remove ail feedstock and other material from the site. In the event the Permit Holder fails to comply with rte terms of this CUP, the City may, upon 30 days' written notice to the Permit Holder enter into the property and perform all such obligations, the costs of which shall be borne by the Permit Holder or, in default thereof, by irs surety. .=377-
