He felt that the <br /> City was entitled to the $38,5000. <br /> <br /> Councilmember Hendriksen stated that the City should not start negotiations at $38,500, but <br /> should start at $43,500. He did not think that the City should concede certain things and then <br /> negotiate on what is left. <br /> <br /> Councilmember Anderson inquired if the City had anticipated the additional $15,000 cost from <br /> S.E.H. <br /> <br /> Director of Public Works/Fire Chief Kapler replied that they did know that as the project <br /> continued to be delayed that they would incur additional costs. <br /> <br /> Councilmember Hendriksen inquired as to who would pay for the additional $15,000. <br /> <br /> Director of Public Works/Fire Chief Kapler replied that it would probably be paid for out of the <br /> liquidated damages the City receives. <br /> <br /> Mayor Gamec stated that he did not see any reason to negotiate the amount of liquidate damages. <br /> Councilmember Zimmerman inqui'red as to what the $15,000 cost was for. <br /> <br />Director of Public Works/Fire Chief Kapler replied that the cost was for additional site visits, <br />correspondence, and many meetings with Ebert Construction. <br /> <br />Consensus of the Council was to direct staff to inform Ebert Construction that the Council is not <br />willing to negotiate the amount of liquidated damages. <br /> <br />2) Aerial Ladder Fire Truck Financing <br /> <br />Director of Public Works/Fire ChiefKapler stated that the Council had requested that he look <br />into the following five issues pertaining to the aerial ladder truck: <br /> <br />1) What is done with buildings of heights greater than the reach of apparatus? <br /> Per the Uniform Building Code, buildings higher than 75 feet must be constructed per Type <br /> 1, or non-combustible materials.
