The Planning Commission also recommended that the City Council include an aerial ladder truck in the 2002 Capital Improvement Budget. Councilmember Anderson inquired as to why the berming issue has not been resolved. Mr. Miller replied that there was some misunderstandings in regards to the height and size of the berm. Everyone now has an understanding of what is required and that is being revised. Councilmember Hendriksen stated that if Amcor is committing to screening consistent with Bury and Carlson they will have no problem. Motion by Councilmember Hendriksen, seconded by Councilmember Kurak, to approve the proposed site plan for Amcor Precast contingent upon compliance with City Staff review letter dated April 27, 2001 revised May 18, 2001. Motion carried. Voting Yes: Mayor Gamec, Councilmembers Hendriksen, Kurak, Anderson, and Zimmerman. Voting No: None. Case #6: Request for a Conditional Use Permit to Exceed Accessory Structure Restrictions; Case of Mr. Stickney Community Development Director Frolik stated that the City received an application from Mr. Stickney requesting a conditional use permit to exceed the detached accessory building square footage restriction and the maximum number of accessory buildings allowed on the property located at 7956 173r~ Avenue. The subject property is approximately 5.1 acres in size and is zoned R-IR Rural Residential. On a 5.1 acre parcel, City Code allows a maximum of 3,264 square feet of detached accessory building space and a maximum of three accessory buildings on the property. The applicant currently has ten accessory buildings on the property and a total accessory building area of 5,967 square feet. Staff met with Mr. Stickney on Tuesday, April 24, 2001. They walked the property in order to get a better understanding of where the accessory buildings are located and what the accessory buildings are being used for. Staff determined that the number and size of the structures does not diminish the use and aesthetics of the property. Staff also observed that Mr. Stickney uses the accessory buildings for cars that he collects and other various hobby equipment and materials that he works on. Mr. Stickney would like to replace an existing 40 x 40 (1,600 square feet) accessory building with a 50 x 30 (1,500 square feet ) accessory building. During the snow winter months the roof of the 1,600 square foot accessory building caved in and as a result it will need to be removed from the property. The existing 1,600 square feet accessory building contains storage of vehicles and other miscellaneous hobby items. Mr. Stickney will move these items into the proposed 1,500 square foot accessory building. If Mr. Stickney replaced the 1,600 square foot accessory building with a 1,500 square foot accessory building, the property would contain a total accessory building area of 5,867 square feet. This is a 100 square foot reduction in accessory building area on the City Council/May 22, 2001 Page 14 of 22
