CASE # <br /> <br />REVIEW STATUS OF CONDITIONAL USE PERMIT COMPLIANCE; <br />CASE OF DANNY'S ALUMINUM PROCESSING, INC. <br /> By: City Attorney William Goodrich and <br /> Community Development Director Sylvia Frolik <br /> <br />Background: <br /> <br />In 1989, the City of Ramsey issued a conditional use permit ("permit") to Dan Karst for an <br />aluminum processing facility on Lot 1, Block 4, Gateway North Industrial Park Plat 2 (14050 <br />Basalt St. N.W.). In 1990, the City Council approved amending the conditional use permit to <br />permit the addition of a second melt furnace to the facility. In 1993, the City Council amended <br />the conditional use permit to allow for the disassembly of engines and transmissions on the site. <br /> <br />On May 8, 2001, the City Council reviewed a historical account of the adminis~ation of the <br />permit and directed City Staff to initiate the proper procedures to consider revocation of the <br />permit. City Staff sent a letter to Mr. Karst identifying several violations of permit conditions <br />and allocated 30 days (until June 23) to correct the violations. <br /> <br />A public hearing was scheduled and properly advertised for June 26 to take public comment, <br />review the status of conditional use permit compliance and consider revocation of the permit. <br /> <br />On June 26, 200i, the City Council called the public heating to order and per Staff's 'request, <br />convened the public hearing to July I0, 2001, and no further action was taken. <br /> <br />Notification: <br /> <br />In accordance with State Statute, City Staff attempted to 'notify property owners within 350 feet <br />of the subject property of the public hearing to review the status of compliance with conditional <br />use permit for aluminum processing facility at 14050 Basalt Street. <br /> <br />Observations: <br /> <br />Staff walked the property on June 20 and 25 and verified that the violations continue to exist. <br />The following items are enclosed: <br /> <br />g. <br />h. <br />i. <br />j. <br /> <br />Site location map <br />Current conditional use permit <br />Excerpt of City Code prescribing process for revoking conditional use permits <br />Historical account of permit administration prepared on April 12, 2001 <br />Letter from City to Mr. Karst dated May 21,200t <br />Letter from City to Mr. Karst dated June 21, 2001 <br />Public hearing notice <br />June 25, 2001 City Staff inspection report <br />Proposed findings of fact <br />Proposed resolution for permit revocation <br /> <br />-125- <br /> <br /> <br />
