! <br />I <br /> <br /> I <br /> I <br />'1 <br /> I <br /> I <br /> I <br /> <br /> Subd. 6. Cancellation of Conditional Use Permits. Unless othe,wdse <br />specified by the Council at the time it is authorized, a conditional use permit, upon written notice <br />being provided by the City to the permit holder but without further action by the Planning and <br />Zoning Commission or Council, shall expire if the permit holder fails to initiate such conditional <br />use permit and fulfill each and every condition attached thereto within one (1) year from the date <br />of its authorization, or if the use is discontinued for a continuous twelve (12) month period, <br />unless a petition for an extension of time in which to complete or utilize the use that has been <br />granted by the Council. Such extension shall be requested in writing and filed with the City at <br />least thirty (30) days before the expiration of the original conditional use permit. The request for <br />extension shall state facts showing a good faith attempt to complete or utilize the use permitted <br />in the conditional use permit. Such petition shall be presented to the Planning and Zoning <br />Commission for a recommendation to the Council and acted upon by the Council. <br /> <br /> Subd, 7. Duration of Conditional Use Permits. A conditional use permit <br />shall remain in effect as long as the conditions ageed upon are observed and the permit holder is <br />in compliance with all other regulations or standards of this Chapter. In addition, one of the <br />conditions may include a specified time limit for the conditional use. <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />I <br /> <br />Subd. 8. <br /> <br />Performance Security <br /> <br />Except in the case of non-income producing residential property (excluding <br />relocated structures), upon approval of a conditional use permit the City <br />shall be provided, where deemed necessary by the Council, with a surety <br />bond, cash escrow, certificate of deposit, securities, or cash deposit pr/or to <br />the issuing of building permits or initiation of work on the proposed <br />improvements or development. Said security shall be non-cancellabie and <br />shall guarantee conformance and compliance with the conditions of the <br />conditional use permit and the ordinances of the City. <br /> <br />The security shall be in the 'amount equal to the City Engineer's-or City <br />Building Official's estimated costs of labor and materials for the proposed <br />improvements or development wh/ch are subject to the conditional use <br />request. A project can be handled in stages upon the discretion of the City <br />Engineer and City Building Official. <br /> <br />The City shall hold the security until completion of the proposed <br />improvements or development and a certificate of compliance with the <br />conditional use permit and ordinances of the City has been issued by the <br />City Building Official. <br /> <br />Failure to comply with the conditions of the conditional use permit or the <br />ordinances of the City shall result in forfeiture of the security. <br /> <br /> Subd. 9. Revocation of Conditional Use Permits.
