-164- ROUGH DIL&FT ORDINANCE NO. 01- CITY OF RAMSEY ANOKA COUNTY STATE OF MINNESOTA AN A_MENDMENT TO CHAPTER 7 WHICH IS KNOWN AS THE LICENSING AND PERMITS CHARTER OF THE CITY CODE OF R_AMSEY, MINNESOTA. An ordinance directing that Ordinance 98-02 be a part of Chapter 7 of the City Code; amending Section 6 of Ordinance No. 98-02 Prohibited Sales and Section 8 of Ordinance No. 98~02 Self Service Sales by exempting certain type facilities and amending Section 3 of Ordinance 98-02 License by providing for licensee education. The City of Ramsey Ordains: SECTION 1. Amendment A. Ordinance 98-02 is hereby codified to become Section 7.93 of the City Code B. Section 6, Paragraph c. "Prohibited Sales" of Ordinance 98-02 is amended to read as follows: By means of self-service methods whereby the customer does not need to make verbal or written request to an employee of the licensed premises in order to receive the tobacco, tobacco product, or tobacco related device and whereby there is not a physical exchange of the tobacco, tobacco product, or tobacco related device between the licensee or the licensee's employee, and the customer, unless the sale is by means of a vending machine controlled y an electronic device by an employee of the business. ~ Ordinance 98-02, Section 8, "Self Service Sales" is amended to read as follows: It shall be unlawful for a licensee under this ordinance to allow the sale of tobacco, tobacco products, or tobacco related devices by any means where by the customer may have access to such items without having to request the item from the licensee or the licensee's employee and whereby there is not a physical exchange of the tobacco, tobacco product, or the tobacco related device between the licensee or his or her clerk and the customer unless the sale is by means of a vending machine which is controlled by the licensee or his or her clerk. All tobacco, tobacco products, and tobacco related devices shall either be stored behind a counter or other area not freely accessible to customers, or in a case or other storage unit not left open and accessible to the general public.
