-14-

Millers only want to sell the Dehen's the minimum amount of property necessary to facilitate the
footprint of the garage; they are not willing to sell the Dehen's additional property to provide for
the 10 foot side yard setback. They plan to gant an easement to the Dehen's to trespass onto
their property when it is necessary to do so in order to conduct maintenance activities on the
north wall or roof of the garage. Therefore, the Dehen's need a variance for a zero setback on the
north side yard. The nearest structure on the Miller property is a detached garage that is
approximately 23 feet away from the Dehen's proposed new garage.
