Norman, City Administrator <br /> <br />Background: <br /> <br />The City had a litigation suit over nonperformance of a purchase agreement brought against it by <br />Anoka County Community Action Program (ACCAP) which was initiated on December 27, <br />2000. The City Council agreed to exercise the purchase agreement of February 18, 1999, during <br />their regular meeting of February 27, 2001. Complications that resulted fi:om wetland mitigation <br />caused the City Council to meet in closed session to discuss the matter with the Attorney. <br /> <br />Based upon the discussion with the Attorney during the closed session meeting on July 5, and a <br />privileged attorney/client session, the settlement agreement is now presented for formal <br />acceptance. A summary of the proposed settlement between the City and ACCAP is attaChed to <br />this case. <br /> <br />Council Action: <br /> <br />Motion to authorize settlement agreement with Anoka County Community Action Program, Inc., <br />based on the recent discussion during the attorney/client privileged meeting held on July 5, 2001 <br />and addressed in the summary. <br /> <br />Reviewed by: <br /> <br />City Administrator <br />City Attorney <br /> <br />07/10/01 <br /> <br />-167- <br /> <br /> <br />
