City Attorney Goodrich explained that all of the properties in the district pay for the entire <br />project. All property owners are equally responsible for the project even though actual <br />construction has not occurred on a particular property. <br /> <br />Councilmember Kurak inquired if this project is being treated the same as if the City were going <br />to do maintenance on a street and the street was not totally completed but yet the fees were <br />already being collected. <br /> <br />City Attorney Goodrich replied that all property owners will be benefiting from the project, it is <br />not a special assessment project but an area wide levy. <br /> <br />Winslow Holasek, 1159 Andover Boulevard, Andover, stated that he has seen two proposals for <br />the layout of the frontage road along Highway #t0 and inquired as to which one was accurate. <br /> <br />Mayor Gamec reviewed the most recent frontage road study. <br /> <br />Mr. Holasek stated that when they met with the City Administrator they were interested in <br />knowing the possible layout of the frontage road along their properties, but they never changed <br />their opinion that the storm sewer system should be on the north side of the tracks. He stated that <br />the properties along that area of Highway #10 are so narrow because of the highway and the <br />railroad tracks and if the City takes land in the front of their properties and in the back of their <br />properties there will be a very limited use for any of the properties. Mr. Holasek stated that the <br />project is premature because they do not need the drainage. He suggested waiting until the land <br />is developed to complete the project. <br /> <br />Mayor Gamec replied that the City has to develop a plan so that there is limited access to <br />Highway #10. The sub drainage district will stay the same, but the layout of the frontage road <br />may change. <br /> <br />Mr. Holasek stated that the frontage road, storm sewer project and development should all occur <br />at the same time. <br /> <br />Councilmember Zimmerman advised the property owners that the EDA and Planning <br />Commission will be reviewing the frontage road study in July. <br /> <br />Mayor Gamec requested that staff notify the interested property owners of the meeting. <br /> <br />Ms. Holasek inquired as to why the drainage pond that was constructed by the City in 1996 never <br />had an outlet. <br /> <br />city Engineer Jankowski reviewed the history of the pond located in Business Park 95. <br /> <br />Councilmember Hendriksen noted that the City decreased the cost of the total project to the <br />extent that it would have cost the City to put the outlet in. <br /> <br />City Council/June 12, 2001 <br /> Page 7 of 19 <br /> <br />-63- <br /> <br /> <br />
