This is to cover the cost of inspecting the storm sewer <br />construction, which discharges into the city-owned detention pond, and for erosion <br />control observations. Upon completion of the Improvements to the satisfaction of the <br />City, any surplus balance remaining in the City's escrow account shall be refunded to the <br />DEVELOPER. <br /> <br />STORMWATER MANAGEMENT FEE. The CITY has enacted a Stormwater <br />Management Fee in the amount of Three Thousand Seven Hundred Forty One Dollars <br />($3,741.00) per commercial acre. The amount of Storrnwater Management Fee due on <br />'the Site is simeen thousand eight hundred thirty five dollars ($16,835.00) (4.5 acres x <br />$3,74I/acre). A cash payment will be required prior to the CITY releasing the Building <br />Permit. <br /> <br />FIRE LANES. Fire lanes shall be maintained on the Site. The exact location of these <br />items on the Site shall be as directed by the City's Fire Chief. <br /> <br />LIGHTING. Any lighting installed on the structure or in the parking lot is subject to the <br />prior approval of the City Engineer and shall be designed so as to deflect light away from <br />all adjacent parcels. Bulbs emitting in excess of 3,000 lumens (150 watts) shall be so <br />directed that the bulb is not visible from off of the property where such light source is <br />located <br /> <br />BUILDING FACAI)E. The Permittee agrees to construct the building exteriors in <br />accordance with the Exterior Elevations prepared by Lampert Architects dated June 6, <br />2001. <br /> <br />REQUIREMENTS FOR BUILDING PERMIT AND CERTIFICATE OF <br />OCCUPANCY. No building permit for the Site Mil be issued until the permittee has: a) <br />signed and returned this Development Permit; b) provided the required cash payment for <br />stormwater management in-accordance with Item #7.of'this Permit; c) provided the <br />required financial guarantee in accordance with Item #13 of th.is Permit; and d) provided <br />the required cash deposit for inspection fees in accordance with Item #6 of this Permit; e) <br />provided the City with a copy of the Grading and' Drainage Permit issued by the Lower <br />Rum River Water Management Organization. No Certificate of Occupancy for the <br />structure will be issued until: a) the Required Improvements are accepted by the City; <br />and b) the landscaping maintenance guarantee has been provided in accordance with <br />Item/413 of this Development Permit. <br /> <br />IMPROVEMENT CONSTRUCTION SCHEDULE. The Required Improvements <br />shall be completed before July 31, 2002. <br /> <br />ESCROW FOR REQUIRED IMPROVEMENTS, In order to ensure the installation <br />of the .Required Improvements in accordance with City specifications and in a timely <br />manner, the Permittee shall be required to deposit with the City a cash escrow or letter of <br />credit, approved as to form by the City, in the amount of sixty nine thousand dollars <br />($69,000) which is 150% of the City's estimated cost of the Improvements.
