Voting No: None. <br /> <br />PUBLIC HEARINGS/BOARD BUSINESS <br /> <br />Case #1: <br /> <br />Request for a Variance to the Rear Yard Setback; Case of Karl and Beth <br />Virkus <br /> <br />Chairperson Nixt closed the regular portion of the Board of Adjustment meeting at 7:00 p.m. in <br />order to conduct the public heating. <br /> <br />Public Hearing <br /> <br />Chairperson Nixt called the public hearing to order at 7:00 p.m. <br /> <br />Presentation <br /> <br />Community Development Assistant Wald stated that Mr. Davis had applied for a variance to <br />encroach into the rear year setback in order to construct an addition onto the principal structure <br />on the property located at 16940 Azurite Street NW. The addition is proposed to encroach five <br />feet into he 35-foot rear yard setback established in the R-1R RuraI District. Mr. Virkus's house <br />was built in the 1970's when the policy was to construct houses to one side of the lot so as not to <br />obstruct any future resubdivision. The Virkus's home is located along the very north edge of the <br />subject property. The addition cannot extend' any further to the north without encroaching into <br />the side yard setback. The property also contains heavy vegetation and low areas along the <br />southern portion of the property and therefore prohibits the construction of a detached accessory <br />building. The proposed addition also cannot extend any more to the south due to the location of <br />the well. The proposed addition will not exceed the accessory building square footage <br />restrictions established in City Code. The subject prop.erty is 1.3-acres in size and the City Code <br />allows 1,664 square feet of accessory building space. The proposed entry and garage addition <br />will consist of 1,600 square feet and the property does not contain any other accessory buildings <br />that count against the total allotment of accessory building space.
