Motion by Board Member Johnson, seconded by Board Member Sweet, to close the public <br />hearing. <br /> <br />Motion carried. Voting Yes: Chairperson Nixt, Board Members Johnson, Sweet, Kociscak, <br />Reeves, and Watson. Voting No: None. <br /> <br />The public hearing closed at 7:41 p.m. <br /> <br />Board Business <br /> <br />Chairperson Nixt called the Board of Adjustment meeting back to order at 7:41 p.m. <br /> <br />Motion by Board Member Johnson, seconded by Board Member Watson, to adopt Resolution <br />#01-06- adopting Findings of Fact # ~ relating to a request by Royal Oaks Realty to vary <br />from the height restriction for the Royal Oaks Realty apartment building and adopt Resolution <br />01-06- to deny a variance to height restrictions for the proposed Royal Oaks Realty apartment <br />building. <br /> <br />Motion carried. Voting Yes: Board Members Johnson, Watson, Kociscak, Reeves, and Sweet. <br />Voting No: Chairperson Nixt. <br /> <br />Case #4: <br /> <br />Request for a Variance to Construct an Accessory Structure Nearer the <br />Front Property Line than the.. Principal Structure; Case of Charles and <br />Kathleen Davis <br /> <br />Chairperson Nixt dosed the regular portion of the Board of Adjustment meeting at 7:47 p.m. in <br />order to conduct the public hearing. <br /> <br />Public Hearing <br /> <br />Chairperson Nixt called the public hearing to order at 7:47 p.m. <br /> <br />Presentation <br /> <br />Community Development Director Frolik stated t___hat Section 9.11.02 of the Ramsey City Code <br />states that no accessory structure shall be constructed nearer the front property line than the <br />principal structure. Mr. Davis has applied for a variance to construct an accessory structure <br />nearer the front property line than the principal structure on the property at 14490 Bowers Drive <br />NW. The property is located on Bowers Drive, alonk'the Mississippi River.. Bowers Drive is <br />considered the front yard and the Mississippi River is considered the back yard. In 1985, the <br />City adopted regulations for properties within the Critical River Corridor. One of the regulations <br />is that there shall be a 200 foot structure setback from the ordinary high mark. Mr. Davis' house <br />is approximately 103 feet from the ordinary high water mark and is considered lawful non- <br />cont'orming.
