I <br /> I <br /> I <br />'1 <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />CASE # <br /> <br />REQUEST TO REZONE PROPERTY FROM INDUSTRIAL TO R-3 URBAN <br />RESIDENTIAL; CASE OF TSM DEVELOPMENT, INC. <br /> By: Community Development Director Sylvia Frolik <br /> <br />Background: <br /> <br />Steve Schmitt of TSM Development has submitted an application to rezone property located at <br />the Northeast quadrant of CSAH #116 (Industry Avenue N.W.) and CSAH #56 (Ramsey Blvd. <br />N.W.) from Industrial to R-3 Urban Residential. The rezoning would allow the property to be <br />developed with townhomes at a density not to exceed 7 units per acre. <br /> <br />The following items are enclosed for your information: <br /> <br />a) Site Location Map <br />b) General Development Plan <br />c) Petition from area residents dated July 27, 2001 <br />d) Letter from Tony & Amy Hauschild dated August 7, 2001 <br />e) Draft Planning Commission meeting minutes dated August 7, 2001 <br />f) Proposed Findings of Fact <br />g) Proposed ordinance <br /> <br />Notification: <br /> <br />State Statute requires notification to owners of property within 350 feet of the Subject Property. <br />Staff attempted to notify owners of property within 500 feet of the Subject Property. <br /> <br />Observations: <br /> <br />The property is 4.77 acres in size and is within the Metropolitan Urban Service Area (MUSA). <br />The general development plan accompanying the application proposes to develop the property <br />with townhomes. The current Comprehensive Plan identifies this area for development with <br />industrial uses. The March 2001 Draft Comprehensive Plan continues to show this area as <br />'places to work'. If the City is inclined to rezone the property for medium density residential <br />development, the current comprehensive plan w~'~uld have to be amended. In addition, the March <br />2001 draft Comprehensive Plan would also have to be modified accordingly. <br /> <br />The development property is bounded on the north and east by single family urban residential <br />development. There are two more smaller parcels south and west of the property that are zoned <br />Industial. Cormexus occupies the property on the south side of Industry Avenue, The land on <br />the west side of Ramsey Blvd. is zoned Industrial and is vacant except for two lawful non- <br />conforming residences. The March 2001 Draft Comprehensive Plan currently shows <br />development of the property on the west side of Ramsey Blvd. with low and medium density <br />residential uses. <br /> <br />-279- <br /> <br /> <br />
