I <br /> <br />I <br />I <br /> <br />I <br />I <br /> <br />I <br />I <br /> <br />Councilmember <br /> <br />introduced the following resolution: <br /> <br />RESOLUTION #01-08- <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT <br />TO DISPLAY AN ADVERTISING SIGN IN A RESIDENTIAL DISTRICT BASED <br />UPON FINDINGS OF FACT # AND DECLARING TERMS OF SAME. <br /> <br />WHEREAS, Mr. Timothy Bergersen (Permittee) has properly applied for a conditional <br />use permit (CUP) on the property legally described as follows: <br /> <br />That part of the Northwest Quarter of the the Southwest Quarter of Section 11, <br />Township 32, Range 25, Anoka County, Minnesota, lying Easterly of West 726 <br />feet of said Quarter, Quarter; except that part described as follows: Beginning at <br />the intersection of East line of said Quarter, Quarter and Northerly Right of Way <br />line of 167~ Avenue NW (said point being 33 feet North of South line of said <br />Quarter, Quarter), thence Northerly along said East tine 540 feet, thence Westerly <br />at right angle 270 feet, thence Southerly parallel with said East line 540 feet to <br />said Northerly right of way line, thence Easterly along said Northerly right of way <br />line 270 feet to point of beginning; also except road subject to easement of record. <br /> <br />(the "Subject Property"); and <br /> <br /> WHEREAS, the Planning Commission met on August 7, 2001, conducted a public <br />hearing and recommended City Council approval of the request. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />Term: This Permit is personal to lVlr. Timothy Bergersen and shall be automatically null <br />and void when Mr. Bergersen ceases his residency on the Subject Property. <br /> <br />Sign Standards. The sign size is restricted to 32 square feet and the height of the sign <br />from grade level to top of structure shall not exceed ~ feet. No part of the sign or base <br />landscaping shall extend beyond the bou~ndafies of the Subject Property. No illumination <br />of the sign is permitted. <br /> <br />Maintenance. The surface and structure of the sign must be kept refinished as necessary <br />and to the City's satisfaction, to prevent tM 2ign surface and support structure fi:om <br />becoming unkempt in appearance and structurally sound. <br /> <br />Severability: If any provision of this Permit shall be declared void or unenforceable, the <br />other provision shall not be affected but shall remain in full force and effect. <br /> <br />-313- <br /> <br /> <br />
