<br />Section D - FOUNDATIONS
<br />
<br />DI Unless other,vise stated In the proposal, Purchaser shall furnish
<br />the foundations, including grouting, or grade or other suppo~ and shall
<br />assume full responsibility for the adequacy and acoxacy of the
<br />foundations or grade or supports. Purchaser shall fill In al excavations,
<br />level the grade, and remove all obstructions In the vicinity of the
<br />construction site before construction is started. Contractor will supply
<br />anchor bolts only when so spec;fred In the proposal.
<br />
<br />D2 Purchaser shall assume full responsibil~ for the beaing capacity
<br />of the soil upon which the structure or the foundation is stq~ported. Any
<br />damage to the foundations or structures caused by failure of the soil to
<br />support the loads upon it shall be repaired at not cost to Coatractor.
<br />
<br />D3 if the structure or any part of it Is to be constructed inside of or
<br />upon an existing building or supports, Purchaser shal assume full
<br />responsibility for the ability of the building or supports to sustain the
<br />loads to be imposed. Any damage to the building or supports, to the
<br />structure, or to any part thereof, because of the Inability of the building
<br />or supports to support these loads, shall be repaired at no cost to
<br />Contractor.
<br />
<br />D4 Foundations shall be constructed to tolerances '~'flich permit
<br />proper erection of the structure without excessive shimming or leveling.
<br />
<br />DS When the foundations are to be designed or built by Contractor,
<br />Purchaser shall provide a subsurface investigation rel3mt by a soils
<br />engineer, specific to the Structure site, or where applicable, multiple
<br />Sb-ucture sites, providing sufficient information for Contractor to design
<br />and build such foundations. When conditions are found lttat differ from
<br />those contemplated in the proposal or shown on the sul:~urface report
<br />or result from inadequate prior subsurface investigation Bcluding but
<br />not limited to requirements for welt-pointing or piling or wet er reck
<br />excavation, the price and delivery schedule shall be appropriately
<br />adjusted. All costs for obtaining adequate subsurface investigation and
<br />modification in design or construction because of subsurface conditions
<br />not disclosed by or which are varying significantly from tJ-~ose assumed
<br />or given in the prior subsurface investigation report ~ be for the
<br />account of the Purchaser.

<br />Section E - WELDING
<br />
<br />E1 All welding procedures and methods shall be consL~ent with the
<br />governing spech'ications or codes although Contractor may select the
<br />procedure or method from available options.
<br />
<br />E2 Examination of the welded joints will be made as the work
<br />progresses in accordance with the applicable code m' specification
<br />although Contractor may select the method of examination from
<br />available options.
<br />
<br />E3 Welding procedures and welding operators will be qualified in
<br />accordance with Section IX of the Code of the American Society of
<br />Mechanical Engineers.
<br />
<br />Section F-PAINTING, COATING, LINING,
<br /> OR INSULATING
<br />
<br />FI Painting, coatings, linings or insulation are included only when
<br />specified in the proposal.
<br />
<br />F2 If weather conditions are unsuitable for application of paints,
<br />coatings, linings or insulation at the time the Structure has been
<br />completed and satisfactorily tested, the Structure shall be accepted by
<br />Purchaser as complete without such painting, coaling, lining or
<br />insulating, subject to the retention by the Purchaser of a reasonable
<br />sum from the contract price to cover the cost of painting, coating, lining
<br />or insulating until such time as Contractor complete the painting,
<br />coating, lining, or insulating.

<br />F3 If shop ~ paints, coatings, linings or insulation are supplied
<br />by Contractor and finish applications are not included in Contractor's
<br />field erection Ix~ion of the proposal, then any cleaning, patching or re-
<br />application of paints, coatings, linings or insulation along the field
<br />erected joints, and any other areas, are not included in the work of
<br />Contractor.
<br /> Section G - TESTING
<br />
<br />G1 This section relates to testing in accordance with the governing
<br />specifications ~ applicable codes. If no test is required, this section
<br />shall not apply.
<br />
<br />G2 If the structure and foundations have been designed for a
<br />hydrostatic test load, the structure shall be tested by filling it with water
<br />immediately upon completion. In other cases, test methods as
<br />described in the proposal or as may be agreed upon between
<br />Purchaser and Contractor shall be followed.
<br />
<br />G3 VV~en hydrostatic test is required, Purchaser shall promptly furnish
<br />all required pipe, hose and titlings, make all connections, fill with
<br />sufficfient water aad dispose of water upon completion of test, all without
<br />cost to Con~or. The Purchaser shall be responsible for .any
<br />corrosion or ar~' ether attack caused by their test water. Contractor will
<br />furnish the proper test gauges and will apply a required test pressure to
<br />pressure vessels.
<br />
<br />G4 If water is net available for testing, the structures shall be tested by
<br />tightness by means of a vacuum box tester, a penetrating oil test, or
<br />such other test method as may be agreed upon between Purchaser and
<br />Contractor. The cost of such alternative testing will be for Purchaser's
<br />accounL
<br />
<br />G5 For pressme vessels, Purchaser shall provide test water at a
<br />temperature no{lower than 60°F.
<br />
<br />G6 Any interconnected construction, piping, or equipment not
<br />furnished by Co~tractor shall be disconnected from the structure by
<br />Purchaser pdort~ tesL
<br />
<br />G7 While the structure is undergoing test, Purchaser shall abide by
<br />and help enfome any safety precaution deemed by Contractor to be
<br />necessary forum safe conduct of any required test.
<br />
<br />Section H - DELAYS
<br />
<br />H1 Any period of delay attributable to causes beyond the reasonable
<br />control of Conlractor shall be added to the time for the completion of the
<br />structure irrespective of whether such causes are operative at the time
<br />of making the contract or at a subsequent time or times. Such causes
<br />shall include, but shall net be limited to, the failure or default of
<br />Purchaser or any subcontractor or supplier to furnish equipment or
<br />material or to do work as agreed upon with Contractor, failure or delay
<br />on the part of Purchaser to provide satisfactory financial information
<br />when requested, failure of any common carrier to transport matedal for
<br />said work according to the prevailing schedule of transportation in effect
<br />at the date of the contract, action or inaction of any governmental
<br />agency having or claiming jurisdiction, stdke or lockout of workers,
<br />acc~denL war, action of mobs or public enemy, any act of lawlessness
<br />interrupting the work or destroying or injuring the material therefor, act
<br />of God, and inclement weather.
<br />
<br />H2 ~,11 cost i~cluding overheads, general and administrative
<br />allowances piss a reasonable profit thereon incurred by Contractor on
<br />account of de~ay or interruption of its work by act or inaction of
<br />governmental or regulatory agency or act or omission on part of
<br />Purchaser or any party acting for or on behalf of Purchaser, including
<br />but not limited to delay caused by failure to furnish accessories,
<br />foundations, test equipment, test water, utilities, components or
<br />materials at or before the time when required, will be for the account of
<br />Purchaser.
<br />
<br />H3 Contractm shall not be liable for consequential loss of revenue or
<br />loss of profit or other remote or indirect loss resulting form any delay.
