-190-

The Applicant is proposing exterior building materials of vinyl siding that closely matches the
home and asphalt shingles. The building will not exceed the 22-foot height limit.

The City has granted conditional use permits in the past for accessory structure square footage
overages. From 1997 to 2001 the City has granted approximately 12 conditional use permits for
accessory structure square footage overages. The chart below shows the lot size and square
footage overage range for the past 4 years;

.86 624
5.1 2,i03
3.3 800
10 2,140
l 0 10,722
1.4 88
1.0 256
1.0 112
3 928
2.3 372
.9 172
35 26,395

* Accessory structure was used for a horse riding arena and/or other farm related activities

Providing a means for Mr. Lind to park his vehicles and equipment indoors is a substantial
overage in accessory building space but it would possibly resolve several outstanding code
enforcement issues. In the event that Charles was not able to construct the detached accessory
building he would be responsible for providing a Class V parking pad under all vehicles and
screening the commercial vehicles to a degree of 75% from adjacent neighbors and public roads.
Screening may consist of existing vegetation, a privacy fence or a combination of both.

[n the event that the property were to change ownership in the future, the excessive overage of
accessory garage space on the property may be appealing for a commercial operation to locate on
the property.

The Planning Commission met on August 7, 2001 to review the conditional use permit request
and held a public hearing. During the public hearing several residents voiced their displeasure
with Mr. Lind's history of accumulating private use and commercial use equipment and vehicles.
The neighbors are concerned that Mr. Lind has already exhausted his accessory structure space
on the property and allowing the accessory structure square footage overage on the property
could provide an opportunity for Mr. Lind to accumulate additional vehicles and equipment.

The City Council met on August 28, 2001 to review Mr. Lind's conditional use permit request.

m
m
m

m
mi
I'
m
m
m
m
m
m
m
m
m
m
m
m
