I
I
I
!
I
I

I
I
I
I
I
I

CASE #

INTRODUCE ORDINANCE AMENDING CHAPTER 5 OF THE CITY CODE
RELATING TO FEES FOR IMPOUNDING DOGS
By: Jo Thieling, City Clerk

Background:

Sergeant Jim Way pointed out that the fees for impounding dogs were listed in Chapter 5 of the
City Code. Since fees are subject to change, the City Council adopts a resolution, annually,
setting the rates, fees, and charges for the current year. That process only takes one action. If
the fees are kept in the City Code, it takes two Council actions to change it - introduction and
finally adoption of an ordinance. Such ordinance has to be published in the Anoka Union, thus
adding publication costs to the actions also. In the past when it's been noted that fees are listed
in the Code, staff has drafted an ordinance for Council's review to introduce and then adopt to
amend that portion of the Code by deleting all reference to specific rates, fee, and/or charges.
The rate is then added to the schedule of rates, fees and charges.

A draft of the ordinance is attached for your review. Also attached is the current language of the
City Code. Providing Council introduces this ordinance, it will be placed on a subsequent
agenda for formal adoption. A resolution will be presented at that time adding the fees into the
current Rates, Fees and Charges Schedule.

Council Action:

Motion by Council to introduce Ordinance #01-XXX amending Chapter 5, Section 5.09.03,
Subd. 10a, of the City Code, deleting reference to a specific fee for boarding and impounding
dogs.

Reviewed by:

City Clerk
City Attorney
Sergeant Way
City Administrator

CC: 09/11/01

-209-
