I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br />.I <br /> I <br /> <br />CASE <br /> <br />INTRODUCE ORDINANCE TO VACATE ROAD EASEMENT; <br />CASE OF JOHN DEHEN <br /> By: Community Development Director Sylvia Frolik <br /> <br />Background: <br /> <br />Mr. John Dehen of 14806 Bowers Drive N.W. is requesting that the City vacate a portion of the <br />roadway easement that exists for Bowers Drive. Mr. Dehen has a failing septic system that also <br />does not meet the setback requirements from the Mississippi River. He is. proposing to replace his <br />septic system in the front yard between the house and Bowers Drive N.W. <br /> <br />Notification: <br /> <br />In accordance with State Statue, property owners within 350 feet of the subject property were sent <br />notice of the hearing pertaining to vacation of road easement and the notice was published in the <br />Anoka County Union. <br /> <br />Observations: <br /> <br />Mr. Dehen hired a septic system designer to design a new system for his property. As mentioned <br />earlier, the septic system is being relocated to the front yard where it will meet the setback from the <br />Mississippi River. The parcel size is very restricted and the proposed location for the system is the <br />only alternative left on the property. During the design of the new system, it became apparent that <br />part of what Mr. Dehen thought was his front yard is actually road right-of-way. Apparently in the <br />vicinity of Mr. Dehen's property, the right-of-way for Bowers Drive expands from the normal 66 <br />feet to more than 100 feet. There is also excess right-of-way in front of the parcel north of Mr. <br />Dehen's and also the next 3 lots to the south. <br /> <br />Mr. Dehen needs the excess right of way in front of his parcel for his new drainfield. Staff has <br />verified that Bowers Drive, as currently constructed, lies within the standard 66 foot right-of-way <br />and does not veer out into this area of excess right-of-way.
