Councilmember Hendriksen stated that private roads means a one time savi~o~the developer,
and the fact that residents of those development have to pay a higher cost. -,~~"0 r~oval and
..... ~ ~. ~
the fact that they keep coming back to the C~ty w~th msues ~s why he is opp~s~t~13~ate
streets. Of the six examples in the City where private streets have been permitted four o~them
have already had problems. He did not see why the City should even consider a policy for
private streets.

City Engineer 01son noted that of the six examples three of the developments are not townhouse
related and three are. He stated that it is very common throughout other communities to allow
private developments because townhomes are more linear and have many more accesses. An
apartment building has a parking area that is designated and there are a lot more people in a
central location. In townhomes they are more spread out so they basically need a longer parking
lot.

Councilmember Hendriksen replied that with the private streets they are not creating a longer
parking lot, but making a narrower road with most of them not having parking and the units
being located very close to the road.

Councilmember Kurak suggested making the arterial streets standard streets, with the driveway
of those streets being private for the access into the units. She felt that performance standards
should be brought up, including the requirement of sweeping streets.

City Engineer 01son stated that he agreed with Councilmember Kurak, but noted the current
ordinance states that private streets are not permitted, so the Council needs to decide first if there
is to be private streets.

Councilmember Kurak stated that she felt that private streets should be permitted.

Councilmember Anderson suggested.that developmentwith private streets be required to include
an area for snow storage.

Councilmember Hendriksen stated that essentially the arterial streets should be City streets and
he would agree with that. Dead ends off that would be driveways and considered private, but
that is where he would draw the line. If they are not driveways then they should be City streets.

Director of Public Works Fire Chief Kapler noted that another aspect that should be considered is
Police. He explained that the Police are limited as to what they can enforce on private streets. If
the arterial roads are public streets that would give the Police a better ability to serve those types
of developments.

Councilmember Kurak in regards to maintenance of private streets she did not feel that the City
should be fixing holes in the roads, but if the arterial road is public then the City would correct

Public Works Committee/August 21, 2001

-57-
