I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> I <br /> I <br /> <br />CASE # <br /> <br />ADOPT ORDINANCE TO VACATE ROAD EASEMENT; <br />CASE OF JOHN DEHEN <br /> By: Community Development Director Sylvia Frolik <br /> <br />Background: <br /> <br />Mr. John Dehen of 14806 Bowers Drive N.W. is requesting that the City vacate the excess road <br />easement that exists for Bowers Drive. Mr. Dehen has a failing septic system and he is proposing to <br />replace his septic system in the front yard between the house and Bowers Drive N.W. The Bowers <br />Drive right-of-way, in the vicinity of Mr. Dehen's home, exceeds the standard 66 foot width by as <br />much as 40 feet in some instances. Mr. Dehen needs the excess right-of-way adjacent to his <br />property fbr a new drainfield. It has been verified that there are no utilities or road pavement <br />outside of the standard 66 foot right-of-way corridor. The following items are enclosed for your <br />information. <br /> <br />a) Site location <br />b) Easement Vacation Exhibit prepared by Hakanson Anderson dated 8/24/01 <br />c) Proposed ordinance <br /> <br />Notification: <br /> <br />In accordance with State Statue, property owners within 350 feet of the subject property were sent <br />notice of the September 11 public hearing pertaining to vacation of road easement and the notice <br />was published in the Anoka County Union. <br /> <br />Observations: <br /> <br />On September 11, the City Council introduced an ordinance to vacate the excess right-of-way on <br />Bowers Drive.
