I am responding to your letters dated <br />September 6, 2001 and September 19, 2001, respectively. In your letter of September 6 you <br />advise that you represent Infinity Builders Corporation ("Infinity Builders"). <br /> <br />I would like to take this opportunity to put in chronological order the relevant events concerning <br />the relationship between our respective clients and the City's Well Pump House No. 3 project <br />(the "Project"). I make no attempt in this chronology to include the miscellaneous telephone <br />calls between the parties. Therefore, the chronology as [ know it is as follows: <br /> <br />1. July 21, 2000. City opens bids for Project. Infinity Builders is the apparent low bidder. <br /> <br />2. August 22, 2000. City adopts its resolution 00-08-225 awarding the Project <br /> construction contract to Infinity Builders. <br /> <br />3. August 28~ 2000. Infinity Builders executes performance bond and payment for the <br /> Project. <br /> <br />4. August 25, 2000. Infinity Builders is notified by City's consulting engineer that it has <br /> been awarded the Project by the City. <br /> <br />5. September 5, 2000. Infinity Builders acknowledges receipt of Notice of Award. <br /> Infinity Builders signs Project Agreement effective as of August 28, 2000. <br /> <br />6. September, 2000. Infinity Builders is made aware of the City's inability to acquire <br /> Project site. <br /> <br />7. September 21, 2000.
