As such, please immediately return to Infinity Builders its payment and performance
bonds and pay rnfinity Builders its termination damages in the amount of $40,5 I4.00 as set forth
in the attachment to my September 6, 2001 letter to Brian Olson.

My letter of September 6, 2001 was clear as to the options available to the City of Ramsey in
light of its August, 2000 contract award to Infinity Builders. The City's apparent attempt to keep
Infinity Builders "on the hook", wNIe at the same time re-bidding the Project to see what prices
could be obtained, is wholly improper and a violation of Minnesota's competitive bidding laws.
At this point, the City is obligated to pay rnfinity Builders its term/nation damages as set forth in
the general conditions of the contract.

Phase contact me with any questions.

PTM/kmd

ve trul o s,

CC:

Brian Oison
Brent Theisen

-364-

TOTAL

I
I
i
I
I
I
I
I:
I
I
I
I
I

!
I
I
I
