Case #8: Request for a Conditional Use Permit to Operate Steel Warehouse BUSiness <br /> in a Residential District; Case of Scott and Patti Jarmoluk .:~,,~iii ,~i,~ ~- <br />Community Development Director Frolik stated that Lonny Menard resides at ~8~40-'t, 81~ Ave <br />and currently owns the parcel to the west (8900 181" Avenue). In 1985 LonnycohstrUcted a <br />5,000 (50' x 100') square foot pole building on the parcel to the west without also constructing a <br />principal dwelling. City Code states that no accessory structure shal["~e-"built withoui"~he' <br />presence of a principal structure (dwelling) on the property. This. WOuld resuItqn the existing..: · <br />accessory structure being considered non-conforming. Mr. Mena~d :has been operating his <br />structural steel and commercial fencing business for the past:Tfi, fteen~' :( iS)· years in the non- <br />conforming accessory building. Mr. Menard is in the processor Selling the' subject property and <br />moving his business to his homestead. As you may recali~ in May of 2000 Mr. Barrett applied <br />for a conditional use permit to operate a woodworking business on the property in the non- <br />conforming accessory structure. Mr. Barrett was proposing a 6,000. square, foot expanmon, <br />employee and customer parking, daily deliveries, and future Plans ~'0ri'self-ktorage units. The <br />City Council denied the conditional use permit on May 23, 2000: Subsequent to that time, the <br />City has received a conditional use permit fi'om Scott and Patti jarmoluk of North Suburban <br />Steel Supply, Inc. to operate a steel warehouse business in the accessory.structure dn the. property <br />located at 8900 18 t~ Avenue. North Suburban Steel Supply, Inc. currently 'operates in the City <br />of Elk River. They have a total, of three employees with operating hours 'of 8:00am - 5:30pm <br />Monday through Friday. North Suburban Steel would t:ike to utilize the existing 5,000 square <br />foot accessory building in Ramsey for warehousing of 'steel products. The Applicants have <br />stated that there would not be any emploYees stationed 'on the Subject property. The purpose of <br />the accessory structure would be solely for storing, steel products until a customer is in need of a <br />product. Truck traffic to the site will vary from day to day depending on customer demand; on <br />an average there would be a maximum of two trucks on the subject property per day. The trucks <br />are proposing to' access the property through an existing Class V driveway. Since 1990, it has <br />been the City's policy to not accept applications for businesses that would operate out of garages <br />and accessory buildings m residential districts.. DUring the conditional use permit review of Mr. <br /> 1 ? .. 't .. that time stated that the best case scenario for <br />Barrett?s apPliCation 'n _000, the: Cl. y Council at <br />the subject property would be' for'a residential dwelling to be constructed on the property and the <br />accessory building utilized for personal storage. In the event that this was not possible, the <br />Council would consider reviewing a conditional use permit request to operate a small business <br />on the' property that would not 'have intentions for expansions. North Suburban Steel Supply <br />does not have any intentions to expand on the property and they do not intend to construct a <br />residential dwelling on the property. The Planning Commission met on August 7, 2001 to <br />review the conditional use permit request and held a public hearing. During the public hearing, <br />two residents spoke m opposition of the conditional use permit to operate a steel business due to <br />the character of the neighborhood being residential, not commercial.
