I <br />I <br />I <br />I <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> i <br /> <br />CASE # <br /> <br /> INTRODUCE ORDINANCE TO VACATE <br />DRAINAGE AND UTILITY EASEMENT IN NORTHFORK OAKS 4TH ADDITION; <br />CASE OF NORTH FORK, INC. <br /> By: Community Development Director Sylvia Frolik <br /> <br />Background: <br /> <br />North Fork, Inc. is the process of developing a new home in Northfork Oaks 4th Addition that is <br />substantial in size. The home buyer is purchasing Lots 4 and 5 of Block 1 and desires to center <br />the home on the property. In doing so, the structure will extend over the common property line <br />between the two lots. <br /> <br />Notification: <br /> <br />In accordance, with State Statue, property owners within 350 feet of the subject property were <br />notified of the October 9, 2001 public hearing. <br /> <br />Observations: <br /> <br />There is a standard l0 foot wide drainage and utility easement on the common property line <br />between the two lots. The City should not issue building permits over drainage and utility <br />easements and a vacation of the easement is necessary. There are no utilities existing in the <br />easement to be vacated. The City Engineer indicates that the vacation of this easement will not <br />impact the drainage plan for the area. ~[ he following items are enclosed for your information: <br /> <br />a) Site location map <br />b) Exhibit of easement to be vacated <br />c) Proposed ordinance <br /> <br />Recommendation: <br /> <br />City staff recommends that Council introduce the ordinance to vacate the utility and drainage <br />easement as requested. <br />Council Action: ~3'-~0~ <br />Motion to introduce Ordinance #01-XX to vacate certain drainage and utility easements in <br />Northfork Oaks 4th Addition. <br /> <br />Reviewed by: <br />City Engineer <br />City Attorney <br />Principal Planner <br />Community Development Assistant <br /> <br />CC: 10/09/01 <br /> <br />-07- <br /> <br /> <br />
