-124- <br /> <br />Such further affidavits of SELLER, certificates of value or other <br />documents as may be reasonably required by BUYER's title company in <br />order to record the SELLER's Closing Documents and issue BUYER the <br />owner's title insurance policy required by this Agreement. <br /> <br /> 13. INSPECTION, BUYER expressly waives the right to perform inspections on <br />the real property or the buildings thereon; however, SELLER agrees to contract to have the <br />Property's soil evaluated. The soil evaluation shall be performed by a company selected by <br />SELLER, and actual manner of evaluation shall be determined by SELLER. SELLER agrees <br />to provide the soil evaluation results to BUYER. <br /> <br /> 14. "AS I$". The Property being purchased by BUYER, including the buildings, <br />other improvements, systems, fixtures, if any, is being sold "as is" without warranties, guaranties <br />or representations of any kind. BUYER understands and agrees that BUYER is not relying on <br />any representations or disclosures made regarding the condition of the Property by the SELLER <br />and BUYER hereby waives any claim, cause of action or suit against the SELLER based on the <br />condition of the Property, or as a result of any representations by SELLER, either written or <br />verbal. The provisions of this paragraph supercede any other language contained in this <br />Agreement regarding the subject hereto. BUYER hereby further agrees that the SELLER shall <br />have no further responsibility or liability with respect to the condition of the Property being sold <br />subsequent to closing and the transfer of the warranty deed. The provisions of this Agreement <br />shall survive closing and delivery of the warranty deed. <br /> <br /> 15. EVIDENCE OF TITLE. Evidence of Title. Within ten (t0) days after <br />execution of this Agreement, SELLER shall furnish BUYER: <br /> <br />An Abstract of Title or Registered Property Abstract, together with proper <br />searches covering bankruptcy, federal and state judgments and tax liens, <br />real estate taxes and special assessments. <br /> <br />A commitment for an ALTA owner's policy of title insurance covering the <br />Property issued by Registered Abstracters Inc. <br /> <br />Co <br /> <br />SELLER may provide a title commitment issued by Registered <br />Abstracters, Inc. to BUYER and, in that case, BUYER waives any claim <br />for an Abstract of Title or Registered Property Abstract. <br /> <br /> 16. EXAMINATION OF TITLE. BUYER shall be allowed until the date ten (10) <br />days after receipt of such title evidence for examination of title and the making of any obi ections <br />thereto, which objections shall be in writing or they will be deemed to be waived.
