It is hereby found and determined that there is a need for the activities in the <br />Development District. <br /> <br /> 2. It is hereby found and determined that the Development District is an area "already built <br />up" within the meaning of Section 469.124 of Minnesota Statutes for the following reasons: <br /> <br />A. The vicinity of the Development District is substantially urban. <br /> <br /> B. The Development District has municipal sanitary sewer, storm sewer and water lines <br />available to it. <br /> <br />C. The Development District has a completed street network available to it. <br /> <br /> 3. It is hereby found and determined that, since initial establishment of the Development <br />District, development and redevelopment needs have changed, requiring expansion of the boundaries' of <br />Development District No. 1 to incorporate certain additional area as further described in the modified <br />Program. <br /> <br />4. It is hereby specifically found and determined that: <br /> <br /> A. The land within the Development District as expanded would not be made available <br />for development without the public intervention and financial assistance described in the <br />modified Program; <br /> <br /> B. The modified Program will afford maximum opportunity, consistent with the sound <br />needs of the City as a whole, for the development of the Development District by private <br />enterprise; and <br /> <br /> C. The Development District and modified Program conform to the general plan for <br />development of the City as set forth in the Comprehensive City Plan. <br /> <br /> 5. It is hereby found and determined that the development program set forth in the Program <br />will carry out the objectives of the Development District by developing a program for improving the <br />City, providing impetus for new development and housing opportunities and enhancing the tax base. <br /> <br /> 6. It is hereby found and determined that the development program as set forth in the <br />Program, having been duly reviewed and considered, is hereby approved. <br /> <br /> 7. That the Council, acting pursuant to section 469.131 of Minnesota Statutes, hereby <br />designates the City Administrator as administrator of the Development District. <br /> <br /> 8. That the Council, acting pursuant to section 469.132 of Minnesota Statutes, hereby <br />declines to appoint an advisow board for the Development District. <br /> <br /> 9. That the Council hereby states that the environmental controls to be applied in connection <br />with the execution of the development program shall consist of the applicable ordinances of this City; <br />and the applicable provisions of Minnesota Statutes. <br /> <br />-163- <br /> <br /> <br />
