SERVICE <br />AREA (MUSA) BASED ON FINDINGS OF FACT # AND DECLARING TERI~IS OF <br />SAME: <br /> <br /> WHEREAS, Jeff Welle (Permittee) have properly applied for a conditional use permit to <br />exceed the detached accessory building height restriction for properties located within the <br />Metropolitan Urban Service Area (MUSA) established in section 9.11.02 "Accessory Uses" of <br />City Code on the property generally known as 15351 Ute St. NW and legally described as <br />follows: <br /> <br />Lot 2, Brock 1, Stanhope Addition, Anoka County, Minnesota <br /> <br />(Subject Property) <br /> <br /> WHEREAS, the Planning Commission met on October 4, 2001, conducted the <br />public heading and recommended City Council approval of the request. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />Based on Findings of Fact #__, a conditional use permit (Permit)to exceed the detached <br />accessory building height restriction for properties located within the MUSA as established in <br />City Code, is hereby granted to JeffWelle, hereinaiSer referred to as the "Permittee" <br /> <br />That the detached accessory building may 'exceed the sixteen (I6) foot detached accessory <br />building height restriction for properties located within the Metropolitan Urban Service Area <br />by a total of i 1 feet in order to match the design and b_eight of the principal structure. <br /> <br />That the construction:of the detached accessory building on the Subject Property shall require <br />issuance of a building permit from the City of Ramsey. <br /> <br />That the accessory building shall be properly constructed and maintained in accordance with <br />all applicable Uniform Building Codes. <br /> <br />The Permittees herein agrees that a business will not be operated in the detached accessory <br />building unless it is in accordance with City Code. <br /> <br />6.
