The applicant will construct an eight foot bituminous path around the rear of the building to allow for fire equipment to be set up to fight any potential fires. The Board of Adjustment did grant a structure height variance of 9.5 feet to a 3-story motel in the commercial district and a 3-story senior apartment building in a residential district that was 44.25 feet in height. On May t, 2001, the Board of Adjustment denied a variance for Amcor Precast to construct a structure reaching 44 feet in height. On appeal, the City Council granted the variance to Amcor Precast. In June 2001, the Board of Adjustment also denied a request from Royal Oaks Realty to allow construction of building that would reach 52 feet in height from grade. At their meeting on September 10, 2001, the Board of Adjustment denied the request for a variance to the height restrictions. Section 9.03.07(1) states that any affected person can appeal the decision made by the Board of Adjustment by providing written notice to the City within ten days of decision. In case the City Council would like to consider granting the variance request, staff has included a proposed findings of fact and resolution granting the variance for your consideration. Recommendation: The Board of Adjustment recommended denial of the applicant's request for a vari c~e to exceed the height restrictions.
