-234- <br /> <br />(the "Subject Property") <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT <br />OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MI2NNESOTA, as follows: <br /> <br />That the Board of Adjustment conducted a public hearing pursuant to Section 9.03.05 of the <br />Ramsey City Code on September 4, 2001 and that said public hearing was properly advertised <br />and that the minutes of said public hearing are hereby incorporated as a part of these findings <br />by reference. <br /> <br />2. That the subject property is proposed to be rezoned from Bi, Business and R3U, Low <br /> Density Multi-Family Residential to MR, High Density Multi-Family. <br /> <br />3. That the subject property is proposed to be subdivided into three lots; One lot will be for two <br /> apartment buildings, one lot for the church building, and one lot for life memorial gardens. <br /> <br />4. That City Ordinances restrict structure heights to 35 feet in all zoning districts. <br /> <br />5. That the Applicant is proposing to construct a three story apartment building that will reach a <br /> maximum height of 52 feet and therefore exceeds the 35-foot height restriction by 17 feet. <br /> <br />6. That the proposed structure is proposed to house at least 47 senior citizens, some of which <br /> may have limited mobility to escape from a fire. <br /> <br />7. The applicant has provided staff with information regarding the height of the third story decks. <br /> The highest point of the third story deck is 32 feet above grade. <br /> <br />8. That the 35-foot height restriction is based on the reach capabilities of fire suppression <br /> equipment in the City's fire department. <br /> <br />9. That the City of Ramsey has a joint powers agreement with the Cities of Anoka and Andover, <br /> which have equipment with reach capabilities in excess of 52 feet. <br /> <br />10. That the preliminary City of Ramsey 2002 budget includes the purchase of an aerial ladder <br /> truck. <br /> <br />11. That if granted, the variance will grant special privilege that is denied to other owners of <br /> lands, structures or buildings in the same district. <br /> <br />12. That if granted, the variance will not impair an adequate supply of light and air to adjacent <br /> property. <br />13.
