(the "Subject Property") NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF Mh-NNESOTA, as follows: That the Board of Adjustment conducted a public hearing pursuant to Section 9.03.05 of the Ramsey City Code on September 10, 2001 and that said public hearing was properly advertised and that the minutes of said public hearing are hereby incorporated as a part of these findings by reference. 2. That the subject property is proposed to be rezoned from BI, Business and R3U, Low Density Multi-Family Residential to MR, High Density Multi-Family. 3. That the subject property is proposed to be subdivided into three lots. One lot will be for two apartment buildings, one lot for the church building, and one lot for life memorial gardens. 4. That City Ordinances restrict structure heights to 35 feet in all zoning districts. That the Applicant is proposing to construct a three story apartment building that will reach a maximum height of 52 feet and therefore exceeds the 35-foot height restriction by 17 feet. 6. That the proposed structure is proposed to house at least 47 senior citizens, some of which may have limited mobility to escape from a fire. 7. The applicant has provided staffwith information regarding the height of the third story decks. The highest point of the third story deck is 32 feet above grade. 8. That the 35-foot height restriction is based on the reach capabilities of fire suppression equipment in the City's fire department. 9. That the City of Ramsey has a joint powers agreement with the Cities of Anoka and Andover, which have equipment with reach capabilities in excess of 52 feet. 10. That the preliminary City of Ramsey 2002 budget includes the purchase of an aerial ladder truck. 11. On September 10, 2001, the Board of Adjustment, at~er reviewing the request and considering the facts of the situation, denied the variance request. 12. On September 19, 2001, the City of Ramsey received a letter from the applicant requesting an appeal of the Board of Adjustment pursuant to Section 9.03.07(1) of City Code.
