Trudgeon: The Minnesota Department of Transportation (NhnJDOT) has reviewed the above referenced plat in compliance with Minnesota Statute 505.03, subdivision 2, Plats. Betbre any further development, please address the following issues: The Phase II seniors housing development proposes an access to Trunk Highway 47. Although there exists a driveway access for a single family home at this location, the proposed development is a change of land use and requires application for a new access permit per Minnesota Rules 88t0.5200. However, access to Trunk Highway 47 will not be allowed because the proposed use is an increase in development intensity. When development intensity increases along a highway, it degades its capacity and safety: The Phase Fi development should be designed to take advantage of existing access from County State Aid Highway 5. Please contact Beth Neuendorf (651-582-I579) in MrdDOT's Design section for additional information. MrffDOT's policy is to assist local governments in promoting comparibiiiry between land use and highways. Residential uses located adjacent to highways often result in complaints about traffic noise. Traffic noise from this highway could exceed noise standards established by the Minnesota Pollution Control Agency (MPCA), the U.S. Department of Housing and Urban Development, and the U.S. Department of Transportation. Minnesota Rule 7030.0030 states that municipalities are responsible for taking ali reasonable measures to prevent land use activities listed in the NLPCA's Noise Area Classification (NAC) where the establishment of the land use would result in violations of established noise standards. MrdDOT policy regarding development adjacent to existing highways prohibits the expenditure of highway funds for noise mitigation measures in such areas.
