Trudgeon: <br /> <br />The Minnesota Department of Transportation (NhnJDOT) has reviewed the above referenced plat in <br />compliance with Minnesota Statute 505.03, subdivision 2, Plats. Betbre any further development, <br />please address the following issues: <br /> <br />The Phase II seniors housing development proposes an access to Trunk Highway 47. Although <br />there exists a driveway access for a single family home at this location, the proposed <br />development is a change of land use and requires application for a new access permit per <br />Minnesota Rules 88t0.5200. However, access to Trunk Highway 47 will not be allowed <br />because the proposed use is an increase in development intensity. When development intensity <br />increases along a highway, it degades its capacity and safety: The Phase Fi development <br />should be designed to take advantage of existing access from County State Aid Highway 5. <br />Please contact Beth Neuendorf (651-582-I579) in MrdDOT's Design section for additional <br />information. <br /> <br />MrffDOT's policy is to assist local governments in promoting comparibiiiry between land use <br />and highways. Residential uses located adjacent to highways often result in complaints about <br />traffic noise. Traffic noise from this highway could exceed noise standards established by the <br />Minnesota Pollution Control Agency (MPCA), the U.S. Department of Housing and Urban <br />Development, and the U.S. Department of Transportation. Minnesota Rule 7030.0030 states <br />that municipalities are responsible for taking ali reasonable measures to prevent land use <br />activities listed in the NLPCA's Noise Area Classification (NAC) where the establishment of the <br />land use would result in violations of established noise standards. <br /> <br />MrdDOT policy regarding development adjacent to existing highways prohibits the <br />expenditure of highway funds for noise mitigation measures in such areas.
