At that time Rademacher made a
counter offer which would have exceeded this amount by $6,720, (the difference of 250-
sq. ft. versus 100/sq ft. on 4480 sq. ft.) The City did not settle for this amount.

In September 2000, the City had a second appraisal of the taking prepared which valued
the damages to the property at $9,540. Following this appraisal the City and Rademacher
verbally agreed to settle the acquisition for the sum of $10,298.80 plus repairing any
direct damages to the property caused by the construction.

At this point in time, payment to Rademacher has still to be made. It should also be
pointed out that the City no longer requires anything from the Rademachers. The
temporary construction easement along TH 47 has expired and the construction is
complete. The area containing permanent drainage and utility easement north of Barium
street, has been sold and platted as a public street. (Barium Street in Orchard Hills
Addition)

In order to bring this acquisition to closure, I will be authorizing payment to Rademacher
in the amount of $10,298.80, the amount agreed upon in September of 2000.

-125-
