I i I I I I I I I I I I I I I I I I CASE # REQUEST FOR COMPREHENSIVE PLAN AMENDMENT; CASE OF JACOB BARTHOLD AND OAKWOOD LAND DEVELOPMENT, INC By: Community Development Director Sylvia Frolik Background: Jacob Barthold, Lee Kappedahl and Oakwood Land Development, Inc:, have submitted an application for an amendment to the 1995 Comprehensive Plan. The request is to expand the Metropolitan Urban Service Area (MUSA) to include approximately 9.7 acres immediately north of the Apple Ridge/River Pines subdivisions. The amendment to the Comprehensive Plan, coupled with their rezoning and subdivision request, would allow the applicants to develop the property with single family homes serviced with municipal water and sanitary sewer. The following items are enclosed for your information: a) Site Location Map b) Proposed Sketch Plan of proposed subdivision c) Planning Commission public hearing and meeting minutes dated 9/10/01 d) Proposed Resolution authorizing submittal to Metropolitan Council Notification: State law requires that the City notify property owners within 350 feet be notified. Staff attempted to notify property owners within 700 feet of the subject property of the request for a MUSA expansion and rezoning. Observations: On behalf of Jacob Barthold and Lee Kappedahl, Oakwood Land Development is requesting an amendment to the 1995 Comprehensive Plan to-expand the MUSA boundary to include the subject property. The 1995 Comprehensive Plan indicates that the subject property is designated as an area of single family homes at rural standards. Inclusion of the property in the MUSA would permit development of single family homes at urban standards. At Mr. Barthold's request, the subject property was part of a Comprehensive Plan amendment initated in 1993 by the City of Ramsey for a MUSA boundary expansion. By the time the amendment was approved by Metro Council in 1995, a portion of Mr. Barthold's property, which is the subject of today's request, was not included in the MUSA boundary expansion exhibit. The fact that this portion of Mr. Barthold's property is not in the MUSA came to light during the preliminary plat review of Apple Ridge (ensuing phases named River Pines) in 1997. The preliminary plat was modified to eliminate this portion of Mr. Barthold's property and as a result, 158th Lane from River Pines 2no Addition to the west,'dead ends on the west boundary of the subject property. -139-
