I <br /> I <br />I <br /> I <br /> I <br /> I <br />,I <br /> I <br />I <br /> I <br /> I <br /> I <br /> i1 <br /> I <br /> I <br /> I <br /> I <br /> ! <br /> I <br /> <br />Councilmember <br /> <br />introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #01-11- <br /> <br />RESOLUTION APPROVING THE ISSUANCE OF AN INTERIM USE PERMIT FOR <br />THE PLACEMENT OF A TEMPORARY OFFICE STRUCTURE AND TO ALLOW <br />FOR OUTDOOR STORAGE, BASED ON FINDINGS OF FACT # , AND <br />DECLARING TERMS OF TIlE SAME. <br /> <br /> WHEREAS, Kenko, Inc., hereinafter referred to as "Applicant", has properly applied to <br />the City of Ramsey (the "City") for an interim use permit on the property generally located at the <br />northeast corner of 147t~ Ave. and Ferret St. and legally described as follows: <br /> <br />Lot 2, Block 1 and Lot 3, Block 1 Hwy 10 Ramsey 4t~ Addition, Anoka County, <br />Minnesota. <br /> <br />(the "Site"); and <br /> <br /> WHEREAS, The Planning CommiSsion met on November 5, 2001, conducted a public <br />hearing and recommended City Council approval of the request. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY TIlE CITY cOuNcIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1) The applicant will be able to have outdoor storage of equipment and maintain a temporary <br /> office building for three years after the approval of the permit. <br /> <br />2) That all outside storage of equipment shall be in an orderly fashion. <br /> <br />That the applicant shall obtain a permit from the Lower Rum River Watershed Management <br />Organization prior to using the land for outdoor storage and placing a temporary office <br />structure on the property. <br /> <br />4) That the applicant shall obtain all necessary permits from the City. <br /> <br />5) That all costs incurred by the City in administering and enforcing this permit shall be the <br /> responsibility of the Permittee. <br /> <br />6) <br /> <br />In the event site operations permanently cease, this Permit becomes null and void and all <br />equipment and structures shall be removed by the Permittee within ninety (90) days of the <br />date of termination of operations. The Permittee shall provide a financial guarantee at the <br />City, in the amount ofTen Thousand Dollars and no cents ($10,000.00) to insure removal of <br />all materials and equipment in the event the Permittee fails to perform said removal upon the <br />termination of operations. The financial guarantee may be in the form of cash, or some other <br />form of financial guarantee such as an irrevocable Letter of Credit or performance bond, <br />acceptable to the City. This financial guarantee shall be maintained at the City as long as the <br />Permit remains in full force and effect. <br /> <br />-129- <br /> <br /> <br />
