I I I C o uncilmem bet [ntroduced the following resolution and moved for its adoption: RESOLUTION' #01-1 I- A RESOLUTION ,dJ)OPTING FIND~G OF FACT #__ RELATING TO A REQb~ST FROM LANCE V,~"~ MOR3,L~N FOR A CONDITIONAl, USE PERtYLIT TO GRAJ)E AND EXCAVATE SOILS WHEREAS, the City of Ramsey received an application from Lance and lody Van Norman and Gary and Louise Jacobs for a conditional use perrmt to grade and excavate soils from the property legally described a.s follows: Lot 2, B lock 2, Northfork Point Addition, A.aoka Coun .ty, Minnesota (the "Subject Property".). NOW THEREFORE, BE IT RESOLVED BY THIS CITY cOuNCIL OF TI-LE CITY OF tL~¥ISEY, ANOK.& COUt'NTY, STATE OF MIN'NESOTA that the findings of fact relating to the request are determined to be as follows: That on June 7, 200I, Lance and lody Van Norman and Gary and Louise Jacobs, hereinafter referred to/as "Applicants", properly applied for a conditional use permit to ~o~-nde and excavate soils so deepen the existing pond on the Subject Property... That the Applicants appeared before the Ramsey Pl'arm/.ng Commission for a public heardmg pursuant to Section 9.03.04 of the City Code on June 7, 2001 and that said public hearing was properly advertised and that the minutes of said public hearing are hereby incorporated as a part of these findings by reference. 3. That the placement of fill material from the excavation of the e,-dsring pond had been completed prior to. the Application for said permit. '- 4. That the Applicants have submitted a Topography Survey dazed May 23, 2001, prepared by John O liver and Associates that identifies the post ~lling condidorm. 5. That the Applicants are proposing that: a) No fill materials, except topsoil for restoration, are proposed to be imported to the site. b) No blasting will be employed in the g-fading activity. c) The e:dsring drainage patterns are not to be substantially altered by the grading conducted. -141- 41
