I <br />I <br />I <br />I <br />I <br />I <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />I <br /> I <br />I <br /> I <br /> <br />Councilmember __ introduced the following resolution and moved for its adoption: <br /> RESOLUTION NO. 01-1l- <br /> <br />A RESOLUTION ,~PPROVING THE ISSIZ,X~NCE OF A CONDITIONAL use PEI~¥[IT <br />BASED ON FINDINGS OF FACT # A~.'¥D DECLAR.IiNG TEIPa¥IS OF PER. lIT TO <br />GR.-kDE .~ND EXCAVATE SOILS <br /> <br /> YVIR~IR~AS, the Ramsey City Council adopted ResO[urJ.0n No. 01-II-... adopting <br />Findings of Fact # for this use and herein approves the Conditional Use Perm.it subject :o <br />the following conditions. <br /> <br />NOW TI--I.ER~YORE BE IT RESOLVED BY THE CITY COLrNCIL OF TIlE CITY OF <br />tLAx¥ISEY, ANOI~-k COUNTY, STATE OF M.~-NiNESOTA, as follows: <br /> <br />On July 24, 2001 a Conditional Use Permit ("CUP'") was issued by the Cit..' of Ramsey <br />("City.") to Lance and Jody Van Norman and Gary. and Louise Jacobs (Permi~ees) for <br />grading ar/d excavating operations on the propert7 legally described as follows: <br /> <br />Lot 2, Block 2, Northfork Point Addition, A. aoka County, MinneSota <br /> <br /> ("Subject Property.:") <br /> <br />T!ds permit is issued pursuant to Section 9.03.04 and 9.1.I8 of the Ramsey Civ Code. The <br />conditions of dtis permit are as follows: <br /> <br />2. The P~.rmittees agree to place six inches of topsoil over the areas of fill identified on the <br /> Topographic mapping prepared by John Oliver and Associates dated May 2_3, 2001. <br /> <br />The Permittees agree to establish a suitable ground cover, of vegetation consisting of a <br />reasonable dense 0arf and omameritai plantings as identirqed on a plan sheet to be submitted <br />by the Applicant and approved by the North Fork Homeowners Association. <br /> <br />4. The Permittees shall olfrain wr/tren permission from the North Fork Homeowners <br /> Association allowing the placement of fill onto Oudot A. <br /> <br />5. The Permittees shall comply wi~ the above conditions by June 30, 2002. <br /> <br />The Permirrees shall implement sediment and erosion control practices. No ~m-ading activity <br />shall occur within ~wenty-flve (25) feet of a property line unless sir fence is placed along the <br />property line to prevent sediment from washing omo the adjoining property. Any erosion <br />which causes gullies of greater than one (1) foot within Oa, enty-five (25) feet of a prope.wy <br />line shall be regraded within forry-e{ght (48) hours of the precipitation event that caused the <br />erosion. <br /> <br />7.
