-46- <br /> <br />Finance Officer Lund stated that staff is currently completing the annual application for general <br />liability and property insurance through the League of Minnesota Cities Insurance Trust <br />(LMCIT). LMCIT requires that city councils officially waive or decline to waive statutory tort <br />liability limits. Effective January 1, 1998, the statutory tort liability limit is $1,000,000 per <br />occurrence; $300,000 per claimant. Claimants who have actual damages that exceed the per <br />claimant limit of $300,000, will not be compensated for damages beyond the $300,000 limit <br />unless the City Council chooses to waive the statutory limits per claimant. With the waiver, <br />actual damages up to the $1,000,000 per occurrence could be paid. Because the potential amount <br />paid for claims increases if the Council chooses to waive the statutory limits, premiums are <br />somewhat higher if limits are waived. Upon advice of the City Attorney, the Council declined to <br />waive the monetary limits in 1998-2001. <br /> <br />Motion by Mayor Gamec, seconded by Councilmember Zimmerman, to recommend that the City <br />Council not waive the monetary limits on municipal tort liability established by Minnesota <br />Statutes 466.06. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Zimmerman, Anderson, <br />Elendriksen, and Kurak. Voting No: None. <br /> <br />Case #4: Purchase of Rifles for Police Department <br /> <br />Finance Officer Lund stated that the Police Department is requesting authorization to purchase <br />two additional~ M-16 military .223 rifles utilizing drug forfeiture funds. One rifle would be <br />placed in the Sergeants squad and the other would be available to Police administration and <br />investigative staff for their squads in the event a critical situation should occur. Currently the <br />Sergeant's squad and the four unmarked cars are not equipped with long guns. Rifles would be <br />purchased fi'om the regional federal level III authorized dealer for these weapons, D.P.M.S., Inc <br />out of Becker, MN. Total cost for a rifle, including current accessories, tax, and shipping is <br />approximately $800/gun. Total purchase would not exceed $1,600. <br /> <br />Motion by Mayor Gamec, seconded by Councilmember Kurak, to recommend that the City <br />Council adopt Resolution #01-11- authorizing the purchase of two M-16's from the Drug <br />Forfeiture Fund in an amount not to exceed $1,600. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Kurak, Anderson, Hendriksen, <br />and Zimme~Tnan. Voting No: None. <br /> <br />Case #2: <br /> <br />Accept Proposals on Terms of Bond Sale For Tax Increment Bonds Series <br />2001C and 2001D <br /> <br />Finance Officer Lund stated that at the October 23, 2001, City Council meeting, Tax Increment <br />District #10 was created to incorporate the development of what will be called the Sunfish <br />Business Park. Land acquisition, street, sewer, water, and storm sewer are necessary costs <br />associated with the development of this park.
