-46- Finance Officer Lund stated that staff is currently completing the annual application for general liability and property insurance through the League of Minnesota Cities Insurance Trust (LMCIT). LMCIT requires that city councils officially waive or decline to waive statutory tort liability limits. Effective January 1, 1998, the statutory tort liability limit is $1,000,000 per occurrence; $300,000 per claimant. Claimants who have actual damages that exceed the per claimant limit of $300,000, will not be compensated for damages beyond the $300,000 limit unless the City Council chooses to waive the statutory limits per claimant. With the waiver, actual damages up to the $1,000,000 per occurrence could be paid. Because the potential amount paid for claims increases if the Council chooses to waive the statutory limits, premiums are somewhat higher if limits are waived. Upon advice of the City Attorney, the Council declined to waive the monetary limits in 1998-2001. Motion by Mayor Gamec, seconded by Councilmember Zimmerman, to recommend that the City Council not waive the monetary limits on municipal tort liability established by Minnesota Statutes 466.06. Motion carried. Voting Yes: Mayor Gamec, Councilmembers Zimmerman, Anderson, Elendriksen, and Kurak. Voting No: None. Case #4: Purchase of Rifles for Police Department Finance Officer Lund stated that the Police Department is requesting authorization to purchase two additional~ M-16 military .223 rifles utilizing drug forfeiture funds. One rifle would be placed in the Sergeants squad and the other would be available to Police administration and investigative staff for their squads in the event a critical situation should occur. Currently the Sergeant's squad and the four unmarked cars are not equipped with long guns. Rifles would be purchased fi'om the regional federal level III authorized dealer for these weapons, D.P.M.S., Inc out of Becker, MN. Total cost for a rifle, including current accessories, tax, and shipping is approximately $800/gun. Total purchase would not exceed $1,600. Motion by Mayor Gamec, seconded by Councilmember Kurak, to recommend that the City Council adopt Resolution #01-11- authorizing the purchase of two M-16's from the Drug Forfeiture Fund in an amount not to exceed $1,600. Motion carried. Voting Yes: Mayor Gamec, Councilmembers Kurak, Anderson, Hendriksen, and Zimme~Tnan. Voting No: None. Case #2: Accept Proposals on Terms of Bond Sale For Tax Increment Bonds Series 2001C and 2001D Finance Officer Lund stated that at the October 23, 2001, City Council meeting, Tax Increment District #10 was created to incorporate the development of what will be called the Sunfish Business Park. Land acquisition, street, sewer, water, and storm sewer are necessary costs associated with the development of this park.
