Town of Clarkstown, <br />2010 WL 2598310 (2d Cir. 2010) <br />The Second U.S. Circuit has jurisdiction over Connecticut, New York, <br />and Vermont. <br />SECOND U.S. CIRCUIT (New York) (06/30/10) —This case addressed <br />the issue of whether a local ordinance providing preferences to wireless <br />telecommunication provider applicants that used "preferred alternate <br />technology" was preempted by the federal Telecommunications Act. <br />The Background/Facts: In 2007, the town passed an ordinance (the <br />"Ordinance ") governing the installation of wireless telecommunications <br />facilities. Among other things, the Ordinance provided a preference in <br />residential areas for smaller and less intrusive antennas. Under the Ordi- <br />nance, wireless telecommunications provider applicants were placed into <br />four categories based on their point score in the application process.
