Councilmember introduced the following resolution and moved for its adoption: <br /> <br />-114- <br /> <br />RESOLUTION #00-11- <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT # TO REZONE CERTAIN <br />PROPERTY FROM R-1 RURAL RESIDENTIAL TO R-1 URBAN RESIDENTIAL <br /> <br /> WHEREAS, the City received an application to rezone certain property in accordance <br />with Section 9.03.03 of the Ramsey City Code. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That Jacob M. Barthold,, Lee Kappedahl, and Oakwood Land Development, Inc., hereinafter <br />referred to as "Applicants," have properly applied to rezone certain property from R-1 Rural <br />Residential to R-1 Urban Residential. <br /> <br />That the Planning Commission conducted a public hearing pursuant to Section 9.03.03 of the <br />City Code on September i 0, 2001, and said public hearing was properly advertised, and the <br />minutes of said public hearing are hereby incorporated by reference. <br /> <br />3. That the property proposed to be rezoned is legally described as follows: <br /> <br />That part of the north 516 feet of the Southeast Quarter of the Southeast Quarter of <br />Section 14, Township 32, Range 25 lying westerly of the centerline of State Highway No. <br />47, EXCEPT that part platted as Apple Ridge. <br /> <br />4. That the total area of the property to be rezoned is approximately 9.7 acres in size. <br /> <br />5. That the Subject Property is currently zoned R-1 Rural Residential and is not located within · the boundaries of the current Metropolitan Urban Service Area fMUSA): <br /> <br />That the adjacent property to the south and west is zoned R-1 Urban Residential and is in the <br />MUSA; the adjacent property to the north is zoned R-1 Rural Residential and is not in the <br />MUSA; the property bounded on the east by T.H.//47. <br /> <br />7. That the proposed rezoning and development of the property will require a Comprehensive <br /> Plan amendment to expand the MUSA boundary to include the Subject Property. <br /> <br />That the Applicants have provided the City with a general development plan dated June 22, <br />2001, (revised October 18. 2001) reflecting the Applicant's intent to develop the Subject <br />Property with single family residential lots~..~'~ except c~,,~w +~o._v existing ~'_v._~,~,~,+~ all to be' <br />served by sanitary sewer and municipal water, as the final phase of the River Pines <br />development projects. <br /> <br /> <br />
