REQUEST TO REZONE PROPERTY FROM B-l- BUSINESS TO R~3 URBAN RESIDENTIAL; CASE OF EIGHTY SEVEN LLC By: Sylvia Frolik, Community Development Director CASE # Background: Eighty Seven LLC has submitted an application to rezone the property located in the soutt~west quadrant of T.H. #47 and 153rd Avenue N.W. from B-1 Business to R-3 Urban Residential. The rezoning would allow the applicant to develop town_homes on the property. The following items are enclosed for your information: a) Site Location Map b) General Development Plan c) Draft Planning Commission distributed at the meeting) d) Proposed Findings of Fact e) Proposed Ordinance meeting minutes dated December 4, '2001 (will Notification: In accordance with State Statutes, owners of property within 350 feet of the subject property were notified of the public hearing regarding the proposed rezoning. Observations: The property is approximately 8.75 acres in size and is within the Metropolitan Urban Service Area (MUSA). The general development plan that accompanied the application proposes to develop the property with townhomes at a density not to exceed 7 units per acre. The current Comprehensive Plan (1995) identifies this area for development with commercial uses. The March 2001 Draft Comprehensive Plan proposes to change the land use of the subject property from commercial to medium density residential. The new Comprehensive Plan has not been finalized and adopted; therefore, if the rezoning is approved, an amendment to the current Comprehensive Plan (1995) will be required. Properties to the south and west of the subject property are zoned R-1 Residential; properties on the north side of 153ra Avenue and the east side of T.H. #47 are zoned B-1 Business. Recommendation: The Planning Commission conducted the public hearing, reviewed the request, and recommended City Council approval of the proposed rezoning. -145-
