REQUEST TO REZONE PROPERTY FROM B-l- BUSINESS <br />TO R~3 URBAN RESIDENTIAL; CASE OF EIGHTY SEVEN LLC <br />By: Sylvia Frolik, Community Development Director <br /> <br />CASE # <br /> <br />Background: <br /> <br />Eighty Seven LLC has submitted an application to rezone the property located in the soutt~west <br />quadrant of T.H. #47 and 153rd Avenue N.W. from B-1 Business to R-3 Urban Residential. The <br />rezoning would allow the applicant to develop town_homes on the property. The following items <br />are enclosed for your information: <br /> <br />a) Site Location Map <br />b) General Development Plan <br />c) Draft Planning Commission <br /> distributed at the meeting) <br />d) Proposed Findings of Fact <br />e) Proposed Ordinance <br /> <br />meeting minutes dated December 4, '2001 (will <br /> <br />Notification: <br /> <br />In accordance with State Statutes, owners of property within 350 feet of the subject property <br />were notified of the public hearing regarding the proposed rezoning. <br /> <br />Observations: <br /> <br />The property is approximately 8.75 acres in size and is within the Metropolitan Urban Service <br />Area (MUSA). The general development plan that accompanied the application proposes to <br />develop the property with townhomes at a density not to exceed 7 units per acre. <br /> <br />The current Comprehensive Plan (1995) identifies this area for development with commercial <br />uses. The March 2001 Draft Comprehensive Plan proposes to change the land use of the subject <br />property from commercial to medium density residential. The new Comprehensive Plan has not <br />been finalized and adopted; therefore, if the rezoning is approved, an amendment to the current <br />Comprehensive Plan (1995) will be required. <br /> <br />Properties to the south and west of the subject property are zoned R-1 Residential; properties on <br />the north side of 153ra Avenue and the east side of T.H. #47 are zoned B-1 Business. <br /> <br />Recommendation: <br /> <br />The Planning Commission conducted the public hearing, reviewed the request, and <br />recommended City Council approval of the proposed rezoning. <br /> <br />-145- <br /> <br /> <br />
