CASE # 2

CONSIDERATION OF REQUESTS FOR COMPREHENSIVE PLAN AMENDMENTS
By: Community Development Director Sylvia Frolik
Principal Planner Pat Trudgeon
Community Development Assistant Megan Wald

A. OAKWOOD LAND DEVELOPMENT

Background:

Jacob Barth°ld, Lee Kappedahl and Oakwood Land Development have submitted an application
for an amendment to the 1995 Comprehensive Plan to expand the Metropolitan Urban Service
Area (MUSA) to include approximately 9.7 acres immediately north of the Apple Ridge/River
Pines subdivisions. The following items are enclosed for your information:

Site Location Map
Proposed Sketch Plan of proposed subdivision
Planning Commission public heating and meeting minutes dated 9/10/01
Proposed Resolution approving comprehensive plan amendment'

At Mr. Barthold's request, the subject property was part of a Comprehensive Plan amendment
initiated in 1993 by the City of' Ramsey for a MUSA boundary expansion. By the time the
amendment was approved by Metro Council in 1995, a portion of Mr. Barthold's property,
which is the subject of today's request, was not included in the MUSA boundary expansion
exhibit. The fact that this portion of Mr. Barthold's property is not in the MUSA came to light
during the preliminary plat review of Apple Ridge (ensuing phases named River Pines) in 1997.
The preliminary plat was modified to eliminate this portion of Mr. Barthold's property and as a
result, 158m Lane from River Pines 2na Addition to the west, dead ends on the west boundary of
the subject property.

The March 2001 Draft Compiehensive Plan proposes to include the subject property in the
MUSA expansion area in order to complete the River Pines subdivisions. The fact that 158m
Lane in River Pines 2nd Addition dead ends on the west boundary of the subject property is
problematic.

The Planning Commission conducted a public hearing on September l0 and recommended
approval of the request to include the property in the MUSA.

Action:

Motion to adopt Resolution #01-12- approving the request for a comprehensive plan
amendment to include the Barthold/KapPedahl property' in Section 14 in the Metropolitan Urban
Service Area and directing City Staff to submit the amendment to Metropolitan Council for
approval.

-49-
