Councilmember Hendriksen requested verification that the first motion was contingent on City obtaining a "no penalty clause" in the agreement that they could get out of the agreement in one year without penalty. Consensus of the Council was that the "no penalty clause" being included in the agreement was part of the motion. Case #2: Consider Revisions to Policy for Appointing Members of the City Boards and Commissions ~:_,,,:::~ Human Resources Manage~ :Heryi~mted that at the end of 2001, there are several commissions requiring new appoM~ents or reaih~ointment and moving ahead with this process requires the final revision of the Ci~,s policyi~ co~ission appointments. Following Council direction on October 9, 2001, the H~ma~ R~:3urze~:-~anager and Councilmember Anderson met to further review and revise the Poli¥'~;f'or;A~i~P;'inti~gMembers of City Boards and Commissions. One area presenting some difficulty~!in' finding a ~tkabte solution was the issue of partial terms and term limits. Currently the policy state~ ~h~t:~mbers of City boards and commissions can serve a total of two consecutive four-year terms of office~.~in.addition to any partial term the individual has been appointed to fulfill for a prgclece;~:~or;,?h~re:has been some concern that partial terms are not limited. For example, somec~'~d~ ~i4'~!'~s:P~e~'ii~ partial term of three years is still able to serve two additional four-year terms and has P~fh~P'k infi-inged upon the intention of term limits. One suggestion was to limit partial terms to on~::!~ear~ ~0~O~r::!imiting partial terms still leaves the problem of filling consecutive partial term§}un~!:,:tti(i~e ~XP~.ation of the original four-year term. Another thought is to simply replace a v{~i4cy ~ a fc~tyear term. Again there is a difficulty in that the four-year ten,ns are intentionally staggered to kde'p::balance and some overlap in experience. .:~, ?~;~i:!~. Councllmember Hendnksen noted that 7.b. of the policy ~;:not correct: He explained that ff the Judge does not make the appointments then the Council ~°uld make the appointments. Human Resources Manager Heryla suggested adding language that would state, "...in the absence of a judicial appointment then the Council makes the decision." Councilmember Anderson suggested that the language match the wording in the Statute. Human Resources Manager Heryla replied that she will get the information and add it to the policy. Councilmember Anderson stated that she had thought that all members on any advisory commission, with the exception of the Charter Commission received a stipend.
