Councilmember Kurak inquired if North Fork, Inc. would be in agreement with that solution. City Engineer Jankowski replied that he did speed to Mr. Peck from North Fork, Inc. and it was · his opinion that it would be a reasonable solution, but would need to discuss if further with other employees. Councilmember Anderson stated that the other alternative would be to haul out the soil. Councilmember Kurak replied that the problem with that is that they can't get machinery into the site to remove the material. City Attorney Goodrich recommending tabling action so that they could get North Fork Inc. involved in the discussions Mr. Van Norman noted tlXat a 12 pg!'gent slope requirement is unreasonable. Her main concern as to do with how the City Attorney Goodrich inquired if it was Ms. McGurk's opinion that covenants are being violated. Ms. McGurk replied that that was very sketchy. She explained that the Board was not sure if it would have held up in the court of law. Scott Christensen, 8970 162® Lane NW, Ramsey, stated that he backs the berm and is looking for some sort of remedy. He certainly felt that the berm could be reduced without hauling out a significant amount of dirt. The outlots are owned by North_ Fork, Inc. not the homeowners association and they are in the process of platting the outlots and selling them to the City Council/November 27, 2001 Page 15 of 22 -37-
