That the accessory structure shall be used for storage of personal property and that no <br />commercial activity of any type shall be permitted in said structure unless it is in accordance <br />with City Code. <br />7. That splitting of the lot is not permitted without removing the new accessory structure or <br />without construction of a principal structure on the resulting new lot. <br />8. That the Permittee agrees that the terms of this variance shall be binding upon its successors <br />and assigns. <br />9. That this variance shall automatically expire if the use is not initiated by May 6, 2011, and <br />issuance of the building permit shall constitute initiation. The Permittee may petition for an <br />extension of time in which to complete the variance. Such extension shall be requested in <br />writing and filed with the City at least 30 days before the expiration of the original variance. <br />The motion for the adoption of the foregoing resolution was duly seconded by Board Member <br />Dunaway, and upon vote being taken thereon, the following voted in favor thereof: <br />Chairperson Van Scoy <br />Board Member Levine <br />Board Member Dunaway <br />Board Member Brauer <br />Board Member Cleveland <br />Board Member Hunt <br />Board Member Rogers <br />and the following voted against the same: <br />None <br />and the following abstained: <br />None <br />and the following were absent: <br />None <br />whereupon said resolution was declared duly adopted by the Ramsey Board of Adjustment this <br />the 6 day of May, 2010. <br />RESOLUTION #10 -05 -101 <br />Page 2 of 4 <br />
